U.S. appeals court blocks Trump from shutting down the census count early

A federal appeals court decided Wednesday to let stand a preliminary injunction barring the Trump administration from shutting down the census count early in the middle of the COVID-19 pandemic.


A three-judge panel of the U.S. 9th Circuit Court of Appeals ruled 2 to 1 that stopping the Census Bureau's count now “risks undermining” its mission.

“Given the extraordinary importance of the census, it is imperative that the Bureau conduct the census in a manner that is most likely to produce a workable report in which the public can have confidence,” wrote Judge Johnnie B. Rawlinson, a Clinton appointee, for the majority. Judge Morgan Christen, an Obama appointee, joined Rawlinson in the ruling.

The panel called the planned speedup "hasty and unexplained."

The decennial census is the most inclusive civic activity in our country, covering every person in every household. The U.S. Constitution requires an accurate count of the nation’s population every 10 years. Moreover, the census is integral to our democracy. The data collected affect our nation’s ability to ensure equal representation and equal access to important governmental and private sector resources for all Americans, including across racial and ethnic lines. Census results are used to allocate seats and draw district lines for the U.S. House of Representatives, state legislatures, and local boards; to target at least $800 billion annually in federal assistance to states, localities, and families; and to guide community decision-making affecting schools, housing, health care services, business investment, and much more. These functions depend on a fair and accurate census.

Unfortunately, certain population groups – referred to as “hard-to-count” – are at a higher risk of not being fully counted in the census. Some of these groups have been historically underrepresented in the census for decades; some may experience new or increased vulnerability due to major changes in methodology, such as relying on the internet as the primary way for households to respond to the 2020 Census; and some may be reluctant to respond due to concerns about data confidentiality. Being hard-to-count can lead to unequal political representation and unequal access to vital public and private resources for these groups and their communities.

African-American households are at risk of being undercounted.

The African-American population has been historically undercounted in the decennial census, disadvantaging their families, communities, and neighborhoods.

The more likely it is that the count for people of color, poor people, homeless people, etc. will be accurate.

This is not a secret plot. Mr. Trump has been trying to whitewash the census since the moment he took office. First his administration tried to add a question about citizenship in an effort to depress the response rate of noncitizens. As one longtime Republican strategist concluded in a 2015 analysis, excluding noncitizens from the census would “be advantageous to Republicans and non-Hispanic whites.” After the Supreme Court poured cold water on that plan last year, Mr. Trump directed the government last month not to count undocumented immigrants for the purposes of reapportioning seats in the House of Representatives. (That’s almost certainly unconstitutional.)

The latest gambit is broader: Ending the crucial in-person canvass one month early will ensure a significant undercount of minorities, as well as rural populations and other groups.

Hope it stands!

Census worker stopped by Sunday, not for me, but for the house 2 doors down. It was empty back in April when they tried it then, so she wanted to know if anyone lived there. I said yes, they just moved in a month ago, but must not be home; that's all she wanted to know. We talked for a few minutes about how important the census was, to keep trying - she was pretty committed. Then she got a text, the office had added another 50 addresses to her list. Wished her luck! Good woman.
