Only solution is to get a democratic trifecta and unpack the court.

Impeachment and removal should not be considered a solution - ever - unless we have a 2/3rds majority in the senate.

(159 posts)just because I had an interview and a friend of mine at the company said that I could work there doesn't mean I was legally hired. I have to be offered by someone that is legally authorized to do so.
Likewise, if there was a legal procedure for confirmation, and the Republicans did not abide by it, then the confirmation did not occur. Is that what happened? What is the legal process for confirmation?

(4,131 posts)The President has nominated her. The senate is going to vote to confirm her. Once nominated and confirmed it is over - it is a lifetime appointment.
Show me where the constitution says that we can remove a Justice because Republicans played fast and loose with committee rules.
Our recourse is to expand the court, implement the Wyoming rule, add states to the union, and enact meaningful voter protections.

Democrats have to decide how tough they want to play. If there is a legal process for nominating a Justice that was not followed, then that Justice was not confirmed. Notify the Court that any ruling she makes will be invalid and nullified. Biden should say, paraphrasing the shithead Andrew Jackson, that "McConnell has made his decision, now let him enforce it." That will be hard for the Senate Minority Leader to do.
I am personally in favor of destroying the Supreme Court completely and starting from scratch. That would take both sides ignoring all accepted norms and customs about the Court. One side has already done that, now it is our turn.
There is no constitutional requirement for the judiciary committee to even make a recommendation.
So, even if we could argue that the vote was not valid... there would still be nothing that could be done if a majority of senators voted to confirm her.

(6,974 posts)Sadly, I'm not seeing that happen. A little hard ball here and there is going to do NOTHING to stop the party of putin. Dems have to be WILLING to grind the broken glass bottle into the party of putin's hands until their hands bleed and are completely shredded.
Do you think Schumer is capable of that? I don't. Even though the party of putin is willing to murder more people by doing nothing to stop tRumpcaronavirus-45, but by also removing the ACA in total only to replace it with NOTHING, so that many more will die without health care or pre-existing coverage.
Prove me completely wrong Schumer should the Dems get the trifecta on November 3rd.
