If we have Biden and a Democratic senate we have a very fast test to see if

we can or can't get something done without getting rid of the filibuster. Try to pass a bill reestablishing the mandate under the normal order of business (ie not via reconciliation). If the GOP doesn't filibuster that then there might be some hope, if not, then we go nuclear. That is a must pass bill for us, if there is no serious offer of negotiation on that, then the filibuster has to go then and there. On edit, I would prefer to just not have the filibuster at all but fear that we won't have the votes for that, but it should be made crystal clear that we won't permit the ACA to be taken from us by minority rule.

we should just kill the filibuster on january 4. just get rid of it up front and don't give them the chance to slow things or create any drama later.

the nuclear option is only needed once the rules are set for that congress.

or at least isn't all the leader. We will have at the very most 54 senators, more likely will have 52 or so. That means we are in a position of needing the votes of all but 2 senators. That gives the trio of Manchin, Feinstein, and any one other veto over this.
