Who can initiate removal of the president under the 25 Amendment? Would it have to be Pence in the case of Trimp

(9,162 posts)That would invoke Article 4 of the Amendment. Trump would say hes competent and take back the presidency. If they challenge his ability to discharge his duties again, it would go to Congress where BOTH houses would need to vote to remove by 67%.
Never gonna happen.

(9,302 posts)the VP AND the majority of the cabinet. Alternatively, the Congress can pass a law to designate "any yther body" to replace the Cabinet in this process

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.
