Trump's appointment of Christopher Miller as Acting Secretary of Defense is illegal.

The Senate-confirmed Deputy Secretary of Defense, David Norquist, was supposed to replace Esper.

And Trump wouldn't be able to appoint Miller as Secretary of Defense, rather than Acting Secretary, because Miller hasn't been out of the military long enough.
