1.) Barr grants DOJ the authority to investigate issues of election irregularities and fraud prior to state certification of vote. (And even seems to encourage it.)2.) It's harder to decertify the state's election result after certification.
3.) The DOJ's investigation finds (invents) irregularities that imply the election was fraudulent (prior to certification of course)
4.) If the state legislature feels (claims) the election was fraudulent, they can choose a different set of electors.
This looks like pieces of a nasty puzzle falling into place. And when that happens, we should be hyper-aware even if it doesn't seem likely, even if it appears farfetched.

(17,862 posts)Ten AGs have already signed on to this travesty. There is already evidence of Barr's DOJ altering documents in other cases. A bad election being thrown to the legislatures has already been accepted in theory as a recourse.

Something like that, I think.

"President Trumps campaign on Monday filed a new lawsuit against Pennsylvanias secretary of state and seven counties, seeking an injunction prohibiting them from certifying the states results of the 2020 election." The Hill)

(2,227 posts)The republican controlled legislatures would surely do this.
Do they have to be asked to do this by their governors? Or just the White House?
But it also made me wonder... There are states who are controlled by democratic legislatures. I know there are fewer dem state legislatures than rep state legislatures. What if the dem states control more electors? Could they do the same and try to balance it out, or reverse the intent?
One thing it WOULD do is get the subject of the Electoral College front and center for a discussion of elimination... Can you imagine if this became the norm?

ANTICIPATE Trump-Barr upcoming argument: the presidential votes should not be certified as the election is "under audit" given open DOJ voting investigations, to which Barr opened floodgates yesterday.

My fears might be baseless, but are shared by many.
Some have said Trump needs only convince state legislators that he election was fraudulent (or give them enough cover for their statement to that effect) they can say they believe to send up another slate of electors regardless of the governor because then it would be put into the lap of the Supreme Court. And he feels he would prevail there.
