I would assume the law only cares about the states actually certifying their elections.

6. Only one state has actually certified their election results as of today (Delaware).

Others certify over the next several weeks.

While they're being total assholes about it, they are most likely not violating the law at this time.

Here's a listing of the dates that each state certifies their results. Note that several stats have no set date.

One of the reasons for suing is when a statute is unclear. It's the court's job to interpret.
