of the McCloskey's lawsuit against the same photographer, claiming the picture 'ruined their lives.'

I hope the case is dismissed and the photographer collects the $1,500 and compensation for all legal fees.

There is a "fair use" clause in copyright, while trademarks have to be defended to remain valid. Aerosmith might not object to "Karen's Got A Gun" and that failure to object would not weaken their copyright on the original. Even if they went to court, the usage might be found to fall under fair use.
