A federal judge based in Pennsylvania has heard enough from Trump attorney Rudy Giuliani.
Judge Matthew Brann of the United States District Court for the Middle District of Pennsylvania on Wednesday announced (PDF) that he was formally canceling an evidentiary hearing that had been scheduled to take place on Thursday.
The evidentiary hearing previously scheduled for Thursday, November 19, 2020 is CANCELLED, the judge wrote in his order, which also denied a motion by Trump attorney Linda Kerns to sanction opposing counsel for a supposedly threatening phone call.
As Law and Crime News reporter Adam Klasfeld notes, Judge Brann telegraphed this move in court on Tuesday when he said that he didnt see the need to hold an evidentiary hearing based on the claims being made by the Trump campaign.
Context: Rudy Giuliani admitted in court yesterday, This is not a fraud case,' writes Klasfeld in explaining why the judge saw no need to hold a hearing on fraud evidence when Giuliani said that the case didnt actually involve fraud allegations.

(32,633 posts)... however I think he's had to hire other lawyers to handle some of these case. Most likely Rudy is charging Chump for the other lawyers' salaries.
Rudy isn't licensed to practice law in a lot of places. It was just mentioned on DU the other day that he allowed his license to lapse in Washington, DC of all places. Lawyers have to pay an annual fee of some amount, and he didn't pay his fee, so they dropped him.
The joke's on Rudy because of course Chump will never pay him $20K per day.

(10,252 posts)which are certainly not being paid by Trump. Probably paid by donors, the campaign, and/or the RNC. How much of the $20K do you think gets kicked back to Trump? Then again, it's probably not even $20K, but that figure is just to make him appear to be that valuable. Har-D-Har-Har. I can't even imagine anyone hiring him post-Trump. He'll probably be chasing ambulances.

Check page 3, subsection 2 and see if you have the "pelosi principles" included. If not you can upgrade to the current contract by executing plan alpha tango tango next time you transit sector 2

(1,040 posts)As a retired paralegal, I've seen my fair share of judicial lectures, tantrums and downright blowups towards attorneys who either a) didn't know what the hell they were doing or b) knew what they were doing but kept trying to advance frivolous arguments. Judges (no matter their political leanings and as a general rule) take very seriously the fact that the Court systems are paid for by the people, and it is "the peoples'" time these fools are wasting. There's also a little judicial arrogance mixed in, and that results in a cocktail no attorney wants poured over their head.
It's obvious from what I read yesterday that Giuliani is no constitutional or legal scholar, and hasn't practiced in some time. He was so in over his head it was laughable -- but the Judge doesn't appear to be amused.
Chalk up another win for our side!

A couple times he corrected the lawyers during court, and I heard the "come on, now" in his tone.
If they had persisted, I can hear the riot act in my head.

I think he's staying in the White House to pull some sort of bullshit.

(11,631 posts)Once the judge began asking each side questions about their arguments, it became clear that Giuliani did not understand basic legal terms.
For instance, Judge Brann asked Giuliani which level of scrutiny he should apply for the dispute. In election law cases, if a strict scrutiny standard is applied, states must overcome a higher bar in defending their voting policies, while under a rational basis standard, states have more leeway in defending their actions.
When Brann asked Giuliani which standard should be applied, Giuliani at first said the normal one.
Brann tried to clarify if Giuliani meant strict scrutiny.

(3,527 posts)Contesting a speeding ticket I didnt feel I deserved. Since I HAD been speeding, but felt I had a good reason for doing so I pled guilty with an explanation. The judge looked at me like I was an idiot and explained, explanation or not, I had just pled guilty and therefore had to pay the fine.
Lesson: dont get up in a court of law if you dont know what the f*** youre doing. A lesson Rudy hasnt learned apparently...

Why did he get himself hooked up with trump? There's enough other shit on sidewalks to step into.
It bothers me when I respect and admire somebody and they take this kind of fall from grace.
