For non lawyers: The Plaintiff relied on ONE case to support standing to sue. The case they used was overturned over 13 years ago.

In fact, many republicans are both bad lawyers and bad politicians. They do, however, excel at messaging, lying, and brainwashing. Sad fact is that hundreds of these bad lawyers now have lifetime appointments as judges.

you went to thick books published by Shepard’s to Shepardize a case. These books would tell you every case that had cited yours, and for what purpose. It would also tell you if the case was still good law. It was a slow and tedious process, but necessary.

Today, most research is done online with Westlaw. When you pull up a case, you can Shepardize online with a touch of a button. More to the point, the case will have one of three flags in the upper left hand corner of the first page. Green means it’s all good. Yellow means the case has been called into question on at least one point by other cases. RED MEANS IT’S NO LONGER GOOD LAW on at least one point.

You may still be able to cite it as “reversed on other grounds,” but you don’t cite it if it’s been reversed or abrogated on the very point of law you want to cite it for. You learn that in the first semester of law school if common sense alone wasn’t good enough to teach you that.

it wasn't that damned hard and it's even easier now, and there is absolutely no excuse for not doing it. The lawyer who cited that case deserved to get his ass reamed.

of my law school and we had one of, if not the first, Westlaw labs.

No it wasn’t hard, although it was a pain using the books if you did a deep dive and read all the citing cases for the key number at issue. Even if it had been hard, it beat the hell out of getting a judicial slap down, or getting fired as an associate who screwed up the research.
