The fantasy of President-elect Biden's DOJ prosecuting Trump is just that - fantasy.

Trump will not leave office without pardoning himself (and issuing a blanket pardon to his administration) or issuing the blanket pardon, resigning, and having Mike Pence pardon him. He simply isnít going to leave office without limiting his Federal legal vulnerabilities.

He will sell his self-pardon and the blanket pardon for his administration as stopping the next ďwitch huntĒ before it gets started.

This will be a blessing in disguise for Biden. He isnít going to have to tangle with the messy issues surrounding prosecuting the former President.

Trumpís real legal liabilities will be in various state courts.

2. Pardons or no pardons, I hope some sort of Truth Commission is established...

.,..anywhere: Congress, the DOJ, a Special Counsel, anybody. We need to *know* what the last five years has done to our country. Get the facts established, from Putin on down. That to me is more important than sending these miserable rabble to prison...

5. SDNY is part of the DOJ.

They went to a lot of trouble to get Trump's tax returns so let's see what shakes out of them on January 21st.

It's not "Biden's" DOJ, it's the American peoples' DOJ. I think that's a distinction that needs to be emphasised after four years of Trump abusing the Department for his own ends.

The Attorney General's job is to enforce the law impartially and to support the district prosecutors in their pursuit of justice. If there are state crimes, which there obviously will be, the the DOJ via SNDY (and EDV, et al) will be pursuing them.

Could you clarify what you mean by this?

SDNY does not investigate or prosecute state crimes. When Trump is pardoned by Pence (or by himself, assuming it holds up), he will have no Federal legal liabilities. SDNY is Federal.
