(10,173 posts)Per the 25th Amendment, he would be able to name a replacement but both the House and the Senate have to confirm it. While McConnell would push it through - and it only needs a majority vote - I don't seem it making it through the House of Representatives.

(9,223 posts)Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.
It might be a little difficult getting that through the House.

(9,223 posts)office when he nominated Ford, who was not only a well liked long time Minority Leader of the House, he testified at his confirmation hearing that he didnt think it was politically possible to pardon Nixon. He was right; it probably cost him a close race to Carter in 1976.
Whatever stooge Trump might nominate in this scenario, would be for the express purpose of pardoning Trumps ass.

(59,507 posts)Interesting that the Democratic House would have an incentive to NOT confirm anyone - which most likely would just mean there would be no VP until Biden is sworn in with Harris.

(16,862 posts)This is all just speculation on what might happen if Mike Pence were to croak in the next few weeks before the inauguration, which is extremely unlikely as well. I was mostly just having a little fun with the possibilities. I fully expect Pence to live and Trumpy to get his pardon well before Biden is sworn in.

(42,799 posts)When Agnew resigned on August 9, it was nearly two weeks until Ford nominated Rockefeller. Then there were hearings on the nomination and Rockefeller wasn't confirmed until mid-December.
In other words, at this point, the office of the VP would remain vacant until it was filled by Harris on January 20, 2021.
