(21,202 posts)The truth is an affirmative defense. However, did they get permission to use the Fox News clips? Doubtful.
Thankfully, the ad is already out there and you can't unring a bell.

(9,062 posts)They need to make a ceremonial sacrifice from time to time to maintain some semblance of impartiality and credibility. Loeffler was that sacrificial lamb.
Fast-forward to today and she's at the center of the struggle for control of the Senate. Oops.

(31,261 posts)Now that she is the Republican choice, Fox has jumped on her bandwagon, so their past words are no longer applicable, at least in their minds.

(46,142 posts)Of course it's not "absolute". But that doesn't prevent copyright owners from threatening copyright infringement actions. Happens all the time.

(1,580 posts)Isn't news public domain?
onenote
(46,142 posts)It is the audio visual presentation. In addition, using a company's trademarked logo without their permission also can raise issues.
Just so it's clear: my point isn't that Fox would prevail on a copyright or trademark claim, but merely that its likely that they asserted such a claim in a cease and desist letter.
The issue of whether and under what circumstances the use of a broadcaster's copyrighted material is or isn't fair use rarely gets litigated to a final verdict because the life-span of the ads that use the material tends to be a lot shorter than the litigation (and the point of making the claim isn't to recover damages but to stop the ad).

(3,431 posts)When it comes to gaining and establishing power, nothing or no one will stand in their way.
Those clips are when Fox was on team Trump and Trump wanted Chris Collins to have that senate seat, and lack the foresight to understand the repercussions.
The insatiable appetite for money and power is often blinding.

(23,343 posts)May it be enough to make the difference (lower turnout in runoffs is a big problem for Warnock and Ossoff, as you know).

(7,794 posts)When they "eat there own" they use scatter guns to bring it down because their aim is poor and to do it right would take.......effort. Oh yeah, and lazy also.
Thinking it through, acting on good intel? Not the FOX way.

(53,214 posts)I honestly didn't realize that Loeffler was appointed, not elected. That would explain a lot. She really doesn't come across as a very appealing candidate, even as a republican. She reminds me more of a villain in a Disney movie.
One thing you can predictably say about the very wealthy is they never have enough money and will do pretty much anything to get more.
OldBaldy1701E
(11,142 posts)another thing you can predictably say is that we, as a rampant capitalistic society, will let them. After all, having money is akin to virtue in our modern society, and that makes vultures like Loeffler paragons in the general eye. Disgusting...

(53,214 posts)Money has been the number one indicator of success and happiness for many, for so long. Unfortunately money has never been a guarantee of happiness. If anything, it has often been the opposite. I believe many people try to fill an emptiness with money, but it often just creates more emptiness.
Some more enlightened people realize they have been very fortunate and choose to give back, but there are plenty who never get enough and are never satisfied. They are too busy wanting more to appreciate what they have, which I suppose would be fine, but they hurt so many people in the process. I think it is an addiction.

(4,123 posts)Verse 1]
Well, I woke up this morning on the wrong side of the bed
And how I got to thinkin' about all those things you said
About ordinary people and how they make you sick
And if callin' names kicks back on you, then I hope this does the trick
[Pre-Chorus 1]
Cause I'm sick of your complainin' about how many bills
And I'm sick of all your bitchin' 'bout your poodles and your pills
And I just can't see no humor about your way of life
And I think I can do more for you with this here fork and knife!
[Chorus]
Eat the rich; there's only one thing they're good for
Eat the rich; I take one bite now, come back for more
Eat the rich; I gotta get this off my chest
Eat the rich; I take one bite now, spit out the rest, uh huh!
[Verse 2]
So I called up my head shrinker, and I told him what I'd done
He said you'd best go on a diet, yeah I hope you have some fun
And a'don't go burst a bubble on the rich folks who get rude
Cause you won't get in no trouble when you eats that kinda food
[Pre-Chorus 2]
Now they're smokin' up the jail bonds, and then they go get stiff
And they're dancin' in the yacht club with Muff and Uncle Biff
But there's one good thing that happens when you toss your pearls to swine
Their attitudes may taste like shit, but go real good with wine!

(3,433 posts)Unless republicans want to be sued for the exact same type of edited usage of media clips, they really ought to just sit back and take it. If they win, you can be sure democrats will never let them get away with it.
