What if he pardons himself or is pardoned by Pence?
I think a case can be made that he is responsible for the deaths of 300,000+ Americans and counting.

That's just not going to happen. His legal jeopardy will be in state court like New York.

(86,791 posts)We aren't members currently but that could change in January. If any of them try to escape to other countries who are members, it may not matter if we extradite them.
If Biden joins the ICC in Jan, we can send them there ourselves.

(855 posts)We are not a signatory of the ICC agreement, so no US citizen can be tried under the ICC. Heck, their investigators are not permitted in the US.

(12,448 posts)it would have put US Military at risk of being tried by the ICC, and no US president is going to allow that.
In order for the US to become a member of the ICC, it would have to pass with 2/3rds approval of the Senate, and I'm pretty sure it would not reach that threshold in the Senate.
