We aren't members currently but that could change in January. If any of them try to escape to other countries who are members, it may not matter if we extradite them.

If Biden joins the ICC in Jan, we can send them there ourselves.

We are not a signatory of the ICC agreement, so no US citizen can be tried under the ICC. Heck, their investigators are not permitted in the US.

it would have put US Military at risk of being tried by the ICC, and no US president is going to allow that.

In order for the US to become a member of the ICC, it would have to pass with 2/3rds approval of the Senate, and I'm pretty sure it would not reach that threshold in the Senate.
