Between the lines: Dominion, which makes the voting machines used in Georgia and elsewhere, has been the subject of baseless accusations of malfeasance during last November's elections.
Trump, during his leaked call with Georgia Secretary of State Brad Raffensperger, called the U.S.-based company "corrupt" and had to be corrected by Raffensperger after claiming machines had been recently removed and/or altered by Dominion employees.
Dominion says that the rhetorical barrage has led to death threats against its employees, including one who remains unable to return to his home.

(130,538 posts)which said that presidents are immune from civil litigation arising from actions taken in their capacity as president. They'd have to convince a court that Trump's defaming Dominion had nothing to do with him being the president, and that it was completely outside the scope of his position. The counter-argument would be that he wouldn't have defamed Dominion if he hadn't been the president. We'll have to wait and see.

(130,538 posts)to do with being president. The Dominion defamation is closer because it relates to Trump's attempt to affect the election results. The holding in Nixon v. Fitzgerald is pretty broad, and it prohibits an examination of the president's motives. The respondent in that case claimed he was discharged from his job for personal reasons and in retaliation for testifying in Congress but he lost anyhow. The court said a president is immune from suit if what he did is even "at the outer limits" of his official functions. I don't think the Dominion defamation is even at the outer limits, but count on Trump to claim it is - and it's arguably closer than the rape case.
