General Discussion
Related: Editorials & Other Articles, Issue Forums, Alliance Forums, Region ForumsCan anyone answer a few questions for me about the attempted coup?
1. Can they expel Cruz and Hawley from the senate? Will they once they seat the new senate?
2. Can Pelosi unseat any congress members that called for this from the congress? Will she?
3. Can trump be arrested and charged for inciting this riot? Does the DA in DC have the authority or will have the be the new AG? And will he? There is a precedent not to charge former presidents but this asshole needs to be charged!!
4. Why are Jr and Eric still walking free and Giuliani? They should be arrested also. What they said incited them also.
5. Is anyone else scared for Biden's safety? I feel they need to have a private swearing in at the WH. Get him in there and then barricade the hell out of it!! Even then I am scared for him until it all settles down.
If these have been answered somewhere else I apologize for repeating. Thank all of you who are smarted than me on all things gov't!!

(113,212 posts)*Article I, section 5 of the United States Constitution provides that "Each House [of Congress] may determine the Rules of its proceedings, punish its members for disorderly behavior, and, with the concurrence of two-thirds, expel a member."

(46,065 posts)1. The Senate can expel members, but it takes a 2/3 vote, so neither Cruz nor Hawley will be expelled.
2. Pelosi cannot unilaterally unseat anyone. As with the Senate, it takes a 2/3 vote of the entire House so don't expect any expulsions.
3. Whether Trump can be arrested between now and January 20 is an unresolved legal issue. But he will not be. And it ill unlikely that the DOJ under President Biden will attempt to charge Trump with incitement, which is a very difficult crime to prosecute. Whether the District of Columbia go after Trump under local law? Possibly, but I wouldn't place too high a bet on it.
4. Because, as noted, incitement is a very difficult crime to prosecute.
5.I think lots of people are concerned about Biden's safety, and not just on inauguration day.

(78,287 posts)Why are these people being released following arraignment?
Do judges really believe that a sternly worded court order to stay out of DC will make a difference?
Not even a hint of home monitoring.
I am very concerned about the upcoming inauguration and the general safety of normal people.
Wtf were these judges thinking to release people who just made a serious attempt to overthrow our government?
