Let's say the House successfully impeaches Trump and it gets sent over to the Senate. Mitch McConnell said the Senate wouldn't have time to schedule their conviction procedure until Jan 19, the day before Inauguration Day. Would the Senate be able to continue the work with the new Democratic majority and a new Majority Leader, would they have to start over, or would the whole thing just get tossed?

(18,486 posts)I have felt that they could not move forward on this after the president left office, but after further thought and study about this, I've changed my mind. I think they can go ahead and try him. If they do convict him, there is only one punishment they can impose - disqualification from holding public office.
FYI, a new majority and new Majority Leader won't affect anything. Even if he were still in office, a Senate with a new makeup could proceed with a trial. The only time something like that would matter is if he was impeached at the end of one Congress before a trial could be had. In such case, I think the impeachment would lapse and the House would have to send over new articles of impeachment.
