(18,486 posts)Unlike other federal judges, Supreme Court justices are the sole arbiters of whether they should or shouldn't recuse from a case. There's no requirement that he recuse if he doesn't want to.
If, however, it is obvious that he is so conflicted that ruling on a case constitutes a high crime or misdemeanor, that could be grounds for impeachment and removal.

(9,714 posts)He would have no choice but to recuse. Or if her participation was one of conspiracy to commit a crime and another conspirator's case found its way to the SC, there would certainly be a conflict of interest.
