The person is questioned with their lawyer, and then the matter is presented to a Grand Jury.
My guess would be late Spring at the earliest.

It would be gross malfeasance not to question someone before issuing an indictment. What if they had an airtight alibi?

In many cases a defendant is indicted before he even knows he is under investigation. Perhaps in some jurisdictions, such as your husband's, it is a custom, but it is not required. btw, I am a former prosecutor.

And she had been on the defense side her whole career (mostly in death penalty work).
You are technically right, but she said she has never seen a case in our state where a serious felony did not go through a Grand Jury.

I admit there are many cases where a defendant should be given the opportunity to state his case before a GJ, such as a case of possible mistaken identity or alibi as you pointed out, but I have never seen that done where violence is concerned and there is no chance of those issues being involved.
