Good defense attorneys give good legal advice and do the best for their client. The photo is what lawyers would can "not a helpful fact". But unless the client insists on a case where they pretend the photo was someone else or staged or photoshopped, there's no point in denying it.
In fact, if the client is best served by testifying against others in exchange for reduced charges, then he really has to acknowledge he was there.

(56,261 posts)I agree that in and if itself, no real downside to just dodging the question. But not at all clear that there's a downside to acknowledging that the photo exists.
If they later want to claim he wasn't there, then yeah, it was stupid. But if they want to cooperate or go with an insanity defense, then it's not a problem.

(6,477 posts)I mean, you're not wrong. They got the guy dead to rights, and there's no use in denying it. But there's also no requirement that you hold a press conference to admit to the crime either.
