is possible, to the horrible behavior of Marjorie Taylor Greene - why are we democrats accepting this? Republicans get away with (*&^%$ and we just say "oh well" - why do Democrats have reasonableness and the other party is tolerating mob attacks, killing, stalking a poor survivor of a mass shooting - can't we fight back some how? ARGHHH!

(33,643 posts)Nobody is above the law, and if you say a lame-duck can't be impeached (and convicted), then they must be subject to civil criminal penalties like anyone else.

(16,375 posts)Might he possibly have issued a "secret" pardon? Sure it's possible but it would have had to have been filed before he left office to be official and it's awfully unlikely that it could be hidden for long.

(18,486 posts)But Congressional Democrats have nothing to do with criminal prosecutions. That's for the Justice Department. And it takes more than a week for DOJ to build a case against anyone, so it's not realistic to expect him to have been indicted by now.

It takes 2/3 of the Senate to Convict an Impeached office-holder.
Both require the participation of Republicans.
Neither will happen.

(6,377 posts)You can bet every Democrat in the House will vote for expulsion. But it takes 2/3rds. We can't force Republicans to vote how we want to.

(146,331 posts)The Senate must try him. The votes may not be there for conviction, but the trial will occur.
There could also be a censure, of course. The two are not dependent on each other.

(68,667 posts)best...one argument they make is Trump will declare victory if he is acquitted which he will be and that will help him get back more power. As for Nancy, she has voted for impeachment and the House managers will prosecute the trial if their is one and as far as I can tell the trial is still on...Nancy has nothing to do with censure.

(18,641 posts)Insurrection against the government, deaths in the Capitol, denial of Constitutional law, elected representatives threatening the lives of others, guns in Congress, accepting total corruption of the presidency and a president who incited insurrection.
What's wrong with that?
They heartily approve of all this as long as it's done by Republicans.
They know there are no consequences for any of this because 2/3 vote is always needed and Democrats don't have it.
And it will continue because nearly half the country votes Republican and Republican voters will not ever, EVER, vote against a Republican. It's not about policy it's about the tribe. If the tribe turns fascist and destroys everyone's life that's fine because it's being done by Republicans.

There's always nuts on the right; we waste WAY too much energy worrying about them. Biden has done way more than even I could have dreamed of in a week.
Oh, and the trial will happen and it will look very bad for the Republicans who don't vote to convict.

(68,667 posts)quite well. But then I never expected we would convict Trump in the Senate. If you look at the situation with how it really is not how you wish it was, you will feel better. We can do quite a bit. I am very pleased with Joe Biden and the Democrats.

(3,635 posts)Whether the Repubs convict or not (likely not, but who knows what McConnell would do) the Repubs will be forced to 'face the music' and see the evidence and vote on it. It's about what side of history they'll be on - the side of Trump and the insurrectionists or on the side of democracy.
I didn't care for Tim Kaine talking about censure now. If we don't get the impeachment conviction then we can start talking about using the 14th Amendement to bar him from ever holding office, which would iirc only take a majority vote.
