You cannot incite a stampede where people get trampled by yelling, "Fire!" in a crowded theater when you know there is no fire. You can be arrested and charged with a crime for making a bomb threat, even if there is no bomb, and regardless of whether you make the threat online, on the phone, or in a letter.

The US gives a lot of leeway in speech because of the first amendment. You can threaten to burn down your neighbor's house, but you will not be arrested unless you actually take steps toward doing it. Then your words become evidence of intent.

If someone is making repeated threats to harm someone, to the point that the threat is harrassment and damaging to someone's psychological well being or livelihood, the person making the threat can be sued for damages.

It has usually been the case that making threats or taking intimidating and agressive actions (stalking, verbally harrassing, blocking physical space) toward someone in government was treated as a crime, or at least as a case for FBI investigation and warning. But that is not happening now and that is what I am angry about. Republicans in Congress are stalking, harrassing, and threatening by implication (carrying forbidden guns) other members of Congress, with impunity.
