Developments in Rittenhouse case unusual

Feb. 4, 2021, 6:28 PM EST
By Ben Kesslen

... Wednesday .. prosecutors didn't know the whereabouts of Rittenhouse, 18, after attorneys failed to notify the court of the address of a "safe house" where he is alleged to be residing ...

"I don't understand why you wouldn't tell the district attorney and the police the location of a murder defendant charged with first-degree murders," said .. Cavanaugh ...

Rittenhouse's attorney .. alleged that police advised his previous attorney .. not to provide the updated address ...

Kenosha police rebutted the claim Thursday ...

.. Kirschner, a former .. prosecutor, said: "It's beyond unusual to lie to a court about where a client is residing. It is no excuse to say that somebody else told me to lie about that. That adds insult to ethical injury" ...

Kirschner said ... "Don't lie to the court" ...

Maybe one rogue cop gave the lawyer “advice”, but one rogue cop is not the official police bureau.

...after a mailed court notice to Rittenhouse’s address was returned, Kenosha Police detectives went to the Antioch, Ill., apartment listed as his official address and found the Rittenhouse family no longer rents the apartment. They found another man had been living there since Dec. 14 ...

The defense motion states that Kenosha County Assistant District Attorney Thomas Binger, in an email exchange with a defense attorney, declined to agree in November to keep the address of the “safe house” sealed in court records. In that email, Binger states that defense attorneys should file a motion with the judge if they wanted the address secret. They did not do so ...

According to Binger, the new home address the defense provided for the court Wednesday is a post office box ...

... The source of Rittenhouse’s bond money made him a flight risk, according to prosecutors, because the money wasn’t his or his family’s and didn’t give him an incentive to remain in the area ...

Rittenhouse’s bond has already been modified by a judge once after he was seen, on the day of his arraignment, at a Racine County bar drinking beer with men flashing hand signs associated with white supremacists ...

Rittenhouse is next scheduled to appear in court for a final pre-trial conference on March 10.

... Assistant District Attorney Thomas Binger says failing to update records with his actual address puts Rittenhouse in violation of his bail conditions that require that within 48 hours of changing. Defense counsel Mark Richards filed an objection noting continued threats ...

Binger notes the only particular threat cited by Richards was an anonymous email to his office indicating what might happen to Rittenhouse in prison. "This is hardly a specific, tangible and imminent threat" that would call for sealing Rittenhouse's address, he wrote ...

9. Put out an arrest warrant, no bail

The bail, IIRC, was paid by others: neither Rittenhouse nor his mother have much if any financial stake in his obeying the terms of his bail. It's not their money, it doesn't matter to them if they forfeit it.

Neither Rittenhouse nor his mother seem to realize just how much trouble he's in: going out of state to drink with mom and pose with proud boys and their ilk isn't going to sit well with a jury. He gives the impression that he doesn't really comprehend that two people are dead, and one maimed, because of his actions.

With all that money for his legal defense, he's feeling like a pretty invincible teenager right now. He has been rewarded with money and fame amongst haters for what he did. Right now, he's living a dream.

Our system enabled him to get this message. It's us. We did it. Our cops gave him water and said they appreciate him, our pResident treated him like a hero, the RW hate machine ponied up huge money and the Court got paid off (via a deeply flawed bond system) to let him out. We did this.

"A lawyer shall not knowingly make a false statement of fact or law to a tribunal or fail to correct a false statement of material fact or law previously made to the tribunal by the lawyer."

Lying to a judge should get a lawyer disciplined.
