... the language of the Constitution and the history of impeachment ultimately suggest the trial can - and should - proceed ...
... the anti-trial side .. points to .. Madisons statements in Federalist No. 39, wherein he contended that the president is impeachable at any time during his continuance in office.
... Madison was distinguishing the proposed federal constitution from some state constitutions that only allowed impeachment once the official was out of office, as well as some that lacked any explicit provision for impeachment of the executive. (54,770 posts)if the POS had done anything else, he could be removed quickly by Senate.
I suppose there is no alternative but to go through with it now, but its not going to punish trump in anyway. Hes not likely to run in 2024, he wouldnt make it through primaries anyway, and no ones mind will be changed by what is presented. Its going through the motions.

(5,271 posts)so its irrelevant that trial is occurring after his Presidency otherwise a Pres. could commit any kind of impeachable offenses right before leaving office with no accountability.
As previous poster mentioned, House impeaching him quickly might have also silenced him and kept him from committing further seditionous acts before Biden's inauguration since Senate could have removed him and punished him more harshly.
