The document is a brief in support of pre-trial detention. It's an argument that Watkins is so dangerous that she should be denied bail. It states that as part of her leadership role in the Oath Keepers and an Ohio "militia" that she "trained and plotted for a moment like this." She described it as "our duty as Americans to fight, kill and die for our rights. In the words of the brief: This was the grave threat that Watkins recruited new militia members to fight against."
However, it also makes clear that Watkins awaited Trump's order to act and would not act without it. In the words of the brief: "As the inauguration grew nearer, Watkins indicated that she was awaiting direction from President Trump."
On November 9th she wrote: "Unless the POTUS himself activates us, its not legit . . . If Trump asks me to come, I will. Otherwise, I cant trust it.
She then made clear that she believed Trump had given his marching orders. Near the end of December she wrote: we plan on going to DC on the 6th because Trump wants all able bodied Patriots to come. She then planned with others equipment to bring and tactics to employ in attacking the Capitol. As she did so she stated: "await orders to enter DC under permission from Trump, not a minute sooner.
On January 4th, two days before she wrote:
It is CRITICAL that all patriots who can be in DC get to DC to stand tall in support of President Trumps fight to defeat the enemies foreign and domestic who are attempting a coup, through the massive vote fraud and related attacks on our Republic. We Oath Keepers are both honor-bound and eager to be there in strength to do our part.

Just like Trump was able to run out the clock on so many legal issues as Prez, Trump allied Senators see hamstringing DOJ under Biden as long as possible as a worthwhile tactic. As much as I want to see criminal charges against Trump at the national level, I think State and local efforts like NY, GA an NYC also have value albeit maybe less symbolically strong.
What I REALLY want to see from DOJ is extensive prosecution of the mob from 1/6 AND the investigation and hopefully indictments against those that plotted and supported it even if not physically present. I would also like to see who in the WH, folks that took the same oath to uphold the Constitution that Trump did, were helping him plot subversion of the election results and blocking of the Constitutional process to certify the Electoral College results. Clearly, Trump didn't come up with all the strategy and tactics that went into laying the foundation for the notion of a "rigged" election prior to the election, all the legal challenges at the state level after the election, the calling of GA and other state election officials to flip the results and so on.
Making the cost through legal proceedings and consequences against the underlings as high as possible now, I think could be a more effective vaccine against similar plots in the future than convicting the impeached Trump in the Senate. I also think, Congressional reps, Senators, their staffs and the Capitol Police filing class action civil lawsuits would be another heavy legal burden on the mob and its enablers that be valuable for both justice and sending a lesson to the future that this tactic does not win or pay.

It really is necessary that while we have Congress and the WH that laws and policies are put in place that make Congressional subpeonas mean something, and disqualification for future Fed positions for violations and the list goes on and on. But we gotta move fast.

(45,438 posts)It's absolutely bizarre how many of these extremists believe Trump had extraordinary powers that he doesn't actually have. Many of them thought he could order a stop of vote counts. Can authorize civilians to conduct law enforcement or militant actions. Can order his supporters to commit acts of violence on other Americans. And so on.

(9,966 posts)I saw a map the other day somewhere of democracies in the world. "Flawed" vs. "absolute". There are very few "absolute", and New Zealand is one. Some of those, like Chile, have a recent history of horrible dictatorships, but are pretty stable now. Iceland is "safe" as well as "absolute", the Scandinavian countries are "absolute" and I suppose relatively safe. Some "flawed" democracies are not terribly unsafe, depending on where you live. Pick your poison, I suppose. I wish I could point you at the map, but I can't. I think I saw it on Twitter. Oh, and would it surprise you at all to know that we live in a "flawed" democracy? Terribly flawed at the moment, I fear.

Always voted, democratic and helped my neighbor when I could.

If you look at the number of RepubliCON voters, does anyone really think that a jury in a criminal court could be seated that doesn't include a number of these Trumphumpers.?????????? I am not a lawyer, but I cannot imagine any of these people being found guilty, regardless of the evidence, by a jury that has even one Trumphumper......
It would be the exact same thing that is about to happen in the Senate when they vote on impeachment...........

(11,563 posts)Problem is, uncorroborated evidence from a perpetrator within the crime is more or less no evidence at all.
Even though the supporting documents were provided by the FBI for a pre-trial bail hearing. Keeping a badass like her in jail instead of being granted bail is a far cry from getting her convicted, let alone a third party.
