5. Apparently using the word 'fight' is the same as instigating the attack on the Capitol.

Cuz - you know, that's the same thing right ?

That Dems should say “we should work” rather than “we should fight.” It would make Dems less scary to the fearful Right.

This is their defense of Donald Trump? I hate to say this, but Trump should ask for his money back. If he paid them anything, that is. These fucking guys are mentally ill.

18. None of our "fighting words" led to a violent insurrection.

Trump’s obviously did. It’s as if they’re proving our case for us.

I suppose the question is whether Trump “should have known” that his fighting words would lead to insurrection, but if he INTENDED to incite insurrection, then what he knew or should have known is irrelevant. He’s guilty if he intended it. He’s guilty if he “knew” it was going to happen (scienter), and he’s guilty if he “should have known” it was going to happen.

A given person might not “know” that shooting a gun into a crowd might kill someone, but if that person shoots a gun into a crowd, and someone is hit by the bullet and dies, said person should be charged with murder and should be found guilty. The fact that the shooter wasn’t certain that someone would die is no defense.
