The question I would have asked had I been a senator

To both sides

It has been argued by the lawyers for the former President that what he did doesn't meet the criminal definition of incitement. If we agree with that and use the Graham standard for Impeachment and conviction (one doesn't have to break the law to lose his job in this republic), then isn't there a January exception to Impeachment if we say the former President can't be convicted here? Wouldn't a future President be able to do exactly and precisely what the former President did as long as he or she doesn't break the law without any way of being punished?
