...you can say a defendant acquitted in court “lost” because 11 of 12 jurors voted “guilty.” Sorry, but an acquittal is an acquittal is an acquittal.

This is about defending the constitution and warning future legislators and future voters. So, a simple majority will be remembered. I agree.
