Cuomo appears to have broken his own policy/State Law

In regards to Ms. Bennett's case, he appears to be in violation of legislation he put in place

A NATION-LEADING ANTI-SEXUAL HARASSMENT AGENDA

Governor Cuomo and New York State are leading the nation with new laws to combat sexual harassment in the workplace. On August 12, 2019, Governor Cuomo signed legislation that strengthened protections against discrimination and harassment under the New York State Human Rights Law. These protections supplement the laws that the Governor signed in April 2019 as part of his 2019 Women's Agenda.

New Protections from Harassment
The Human Rights Law now protects victims of harassment, including sexual harassment, in important new ways such as ensuring that harassment does not need to be severe or pervasive to be against the law.

Cuomo says he was joking.
At work sometimes I think I am being playful and make jokes that I think are funny.

What does the law have to say about that?

From the FAQ Section

A3. Your employer is required to provide a workplace free from sexual harassment, regardless of who the harasser is
