UPDATE: As of March 3, more than 300 defendants have been charged in federal court from 40 states. Of those, 87 were also indicted by grand juries, according to documents reviewed by CBS News: 26 Texans, 22 from New York while Florida and Pennsylvania each had 20.
CBS NEWS reports the following stats:
20 have been charged under a destruction of government property statute.
40 people have been arrested for assault on law enforcement officers.

"Are you saying ... you don't know whether the bureau has scooped up geolocation data, metadata cellphone records from cellphone towers?" Hawley asked Wray during a Senate Judiciary Committee hearing on Tuesday. "Do you not know, or are you saying maybe it has or maybe it hasn't? Tell me what you know about this."
Wray replied he would "not be surprised to learn" but does not "know for a fact that we were using geolocation data under any situation in connection with investigation into the 6th....."

Attorneys for Rep. Bennie Thompson (D-MS) and the NAACP have served former President Donald Trump at his Mar-a-Lago club with a lawsuit filed against him in February.
Thompson and the NAACP filed suit against Trump alleging that his incendiary rhetoric and false claims of a stolen election amounted to a conspiracy to interfere with civil rights by inciting the Jan. 6 riot at the Capitol.
The suit names Trump alongside his attorney Rudy Giuliani and the right wing extremist groups, the Proud Boys and the Oath Keepers, as co-defendants and builds off the 1871 Ku Klux Klan Act, which was intended to protect against conspiracies, through violence and intimidation, that sought to prevent Members of Congress from discharging their official duties, according to a complaint.
The Defendants conspired to prevent, by force, intimidation and threats, the Plaintiff, as a Member of Congress, from discharging his official duties to approve the count of votes cast by members of the Electoral College following the presidential election, the lawsuit alleges.
It accuses the defendants of acting in concert to incite and then carry out a riot at the Capitol that created grave danger of harm to Thompson and other lawmakers.

South Carolinian William Robert Norwood III is facing federal charges after allegedly telling a family member he assaulted and stole gear from police officers during the Capitol riot.
"I'm dressing in all black," Norwood wrote under the name "Robbie" on January 5, the day before the riot and insurrection, according to text messages cited in an FBI affidavit. "I'll look just like ANTIFA. I'll get away with anything."
After the riot on January 6, additional text messages obtained by the FBI show Norwood claimed he tested his theory.
"I got away with things that others were shot or arrested for," Norwood wrote, according to the affidavit.
Norwood repeatedly claimed in the text messages the only reason why police allowed him to assault him was because he was dressed like Antifa.

At 1:51 p.m. on Jan. 6, a right-wing radio host named Michael D. Brown wrote on Twitter that rioters had breached the United States Capitol and immediately speculated about who was really to blame. Antifa or BLM or other insurgents could be doing it disguised as Trump supporters, Mr. Brown wrote, using shorthand for Black Lives Matter. Come on, man, have you never heard of psyops?
Only 13,000 people follow Mr. Brown on Twitter, but his tweet caught the attention of another conservative pundit: Todd Herman, who was guest-hosting Rush Limbaughs national radio program. Minutes later, he repeated Mr. Browns baseless claim to Mr. Limbaughs throngs of listeners: Its probably not Trump supporters who would do that. Antifa, BLM, thats what they do. Right?
What happened over the next 12 hours illustrated the speed and the scale of a right-wing disinformation machine primed to seize on a lie that served its political interests and quickly spread it as truth to a receptive audience. The weekslong fiction about a stolen election that President Donald J. Trump pushed to his millions of supporters had set the stage for a new and equally false iteration: that left-wing agitators were responsible for the attack on the Capitol...egged on only minutes earlier by a president who falsely denounced a rigged election and exhorted his followers to fight for justice history was being rewritten in real time.
Within hours, a narrative built on rumors and partisan conjecture had reached the Twitter megaphones of pro-Trump politicians. By days end, Laura Ingraham and Sarah Palin had shared it with millions of Fox News viewers, and Representative Matt Gaetz of Florida had stood on the ransacked House floor and claimed that many rioters were members of the violent terrorist group antifa.
Nearly two months after the attack, the claim that antifa was involved has been repeatedly debunked by federal authorities, but it has hardened into gospel among hard-line Trump supporters, by voters and sanctified by elected officials in the party. More than half of Trump voters in a Suffolk University/USA Today poll said that the riot was mostly an antifa-inspired attack. At Senate hearings last week focused on the security breakdown at the Capitol, Senator Ron Johnson, a Wisconsin Republican, repeated the falsehood that fake Trump protesters fomented the violence.

Federal prosecutors say a Seattle-area resident was nominated to have "war powers" to lead the Proud Boys on January 6, as they continue to allege that members of the Trump-supporting extremist group were prepping, communicating and organizing an attack on the Capitol.
Ethan Nordean, who will appear in court Tuesday, was allegedly ready to step in and lead the Proud Boys' violent push to overtake the US Capitol, a new court filing said, after the group's leader, Enrique Tarrio, was arrested and then told to stay away from Washington, DC.
"Following the arrest of the Proud Boys' Chairman on January 4, 2021, Defendant was nominated from within to have 'war powers' and to take ultimate leadership of the Proud Boys' activities on January 6, 2021," prosecutors wrote in a court filing Monday arguing to keep Nordean imprisoned.
"Defendant -- dressed all in black, wearing a tactical vest -- led the Proud Boys through the use of encrypted communications and military style equipment, and he led them with the specific plans to: split up into groups, attempt to break into the Capitol building from as many different points as possible, and prevent the Joint Session of Congress from Certifying the Electoral College results," prosecutors added.
As part of their efforts, the group distributed Chinese-made Baofeng multifrequency radios, planned to meet at the Washington Monument at 10 a.m. and intentionally abandoned President Donald Trump's speech railing against the election to get in position to overtake the Capitol, prosecutors said.

On the evening of Jan. 5, prosecutors say, participating Proud Boys were instructed to meet at the Washington Monument at 10 a.m. the next day to await further orders, wearing plain clothes and "no colors."
"In order to increase the odds that their plan would succeed, Defendant and those Proud Boys following him dressed 'incognito' and spread out to many different locations from which they could force entry into the Capitol," prosecutors wrote, adding that the Proud Boys likely knew from experience that the group's typical tactic of marching in uniform and in unison could alert law enforcement.
A group gathered accordingly and began walking toward the Capitol with Nordean in the lead, reportedly dressed in all black, wearing a tactical vest and carrying a bullhorn. The filing notes that the group marched to a pedestrian entrance to the Capitol grounds secured by a small number of police officers and a waist-high metal barrier around 12:53 p.m. ET.
Then-President Donald Trump's speech on the Ellipse did not end until after 1 p.m., prosecutors noted.
"Defendant and those he was leading were not present for any part of the speech, because hearing the speech was not in their plan," they wrote. "While other persons who would later participate in the Capitol riot were watching former President Trump speak, Defendant was leading Proud Boys members on a march around the Capitol and positioning them at an entrance to the Capitol grounds that was guarded by only a handful of Capitol Police officers."

(28,979 posts)A video documentary produced by the Wall Street Journal showed that, on January 6, Nordean and fellow Proud Boys leader Joe Biggs from Florida commanded a mob of about 100 Proud Boys members and supporters who assembled east of the United States Capitol Building. A video livestreamer who is a member of the Proud Boys described Biggs and Nordean as "Two men on a mission, with about 500 behind them ready to kick some butt for the benefit of this country".[2]
They marched south past the Library of Congress and the Supreme Court building, and circled around the Capitol complex, approaching from the northwest. The Proud Boys contingent constituted a "a large proportion of the first wave" that reached the Capitol, and one Proud Boys member used a seized police shield to break a window to gain access to the building.[18]
Nordean was accused of being "a chief organizer of a mob of about 100 other members of the group that marched through Washington" before the breach of the Capitol.[19]
Arrest and aftermath
According to prosecutors, on January 8, Nordean posted an image of a Capitol Police officer shooting pepper spray at rioters. The caption read, "If you feel bad for the police, you are part of the problem..."[20] On February 3, Nordean was arrested and charged with four federal crimes, including obstructing an official proceeding, aiding and abetting injury to government property, disorderly conduct and knowingly and violently entering a restricted building. If convicted on all four charges, Nordean could be sentenced to up to 40 years in prison.[2]
On February 7, a federal judge in the state of Washington denied Nordean's bail request, and ordered him to be returned to Washington, DC pending trial. Prosecutors argued that "There is no reason to believe that Defendant, or any of his Proud Boy associates, are any more interested in 'complacency,' or any less interested in fomenting rebellion, than they were on January 5," adding, "If nothing else, the events of January 6, 2021, have exposed the size and determination of right-wing fringe groups in the United States, and their willingness to place themselves and others in danger to further their political ideology."[21]

DOD Took Hours To Approve National Guard Request During Capitol Riot, Commander Says
"At 1:49 p.m., I received a frantic call from then-chief of U.S. Capitol Police, Steven Sund, where he informed me that the security perimeter at the Capitol had been breached by hostile rioters," Maj. Gen. William Walker told the Senate Homeland Security and Rules committees in a joint hearing.
"Chief Sund, his voice cracking with emotion, indicated that there was a dire emergency on Capitol Hill and requested the immediate assistance of as many guardsmen as I could muster."
Walker said he "immediately" alerted Army senior leadership of the request. He was not informed of the required approval from then-acting Defense Secretary Christopher Miller until 5:08 p.m., he said "3 hours and 19 minutes later."
"We already had guardsmen on buses ready to move to the Capitol. Consequently, at 5:20 p.m. (in under 20 minutes), the District of Columbia National Guard arrived at the Capitol. We helped to reestablish the security perimeter at the east side of the Capitol to facilitate the resumption of the joint session of Congress," he said.
Walker said he had taken it upon himself to move the guardsmen closer to the Capitol in anticipation of the approval to mobilize. He said about 155 guardsmen were ready hours earlier, and he said their assistance "could have made a difference" in pushing back the crowd.

It was not untoward for Lt. Gen. Charles Flynn to be on the call, given his role as the Armys deputy chief of staff for operations, plans and training. The Armys initial denial of his participation, however, raises questions as to the transparency of the Pentagon in revealing the facts surrounding that day.
Charles Flynn told the Post that he was in the room for a portion of a phone call during which the Capitol Police and D.C. officials urged the Pentagon to send more National Guard troops to respond to the violence after a mob of Trump supporters descended on the Capitol Building.
The rioters overwhelmed police, broke into the structure and disrupted lawmakers meeting to certify President Biden's Electoral College win. Five people are dead as a result of the chaos, including a Capitol police officer.
Top Army officials, however, were reportedly concerned about the optics of sending the guard to the Capitol.

The Justice Department has charged a Texas man with assaulting law enforcement outside the U.S. Capitol on Jan. 6 after newly resurfaced videos allegedly show him dousing over a dozen police officers holding the line with some type of chemical irritant and bragging about it at his hotel hours later, recently unsealed court documents said.
Daniel Ray Caldwell, 49, of The Colony, Texas, was arrested on Feb. 10 in Richardson, Texas, Melinda Urbina, a spokeswoman for FBI-Dallas Division, told Fox News. He was indicted on four offenses: assaulting, resisting, or impeding federal officers; obstruction of law enforcement during civil disorder; knowingly entering or remaining in any restricted building or grounds without lawful authority; and violent entry and disorderly conduct on Capitol grounds.

On Wednesday, Reuters reported that a federal Drug Enforcement Administration agent who joined the crowd outside the Capitol during the violent invasion on January 6th has been suspended pending investigation the first such probe into a federal officer.
"The agent, Mark Ibrahim, declined to comment other than to say in a phone interview that he 'never entered the building,' when the crowd breached the Capitol on Jan. 6, setting off violence that left five dead," reported Brad Heath. "One of Ibrahim's lawyers, Gretchen Gaspari, said DEA officials told Ibrahim that they were putting him on leave and suspending his security clearance 'because of his presence on Jan. 6.'"

According to NBC4 investigative reporter Scott MacFarlane, Barnett began "screaming" at attorneys and the judge, saying that it's "unfair" that he's been locked up "for a whole month."

On Thursday, POLITICO reported that a former staffer in the Trump administration has been arrested in connection with the invasion of the U.S. Capitol on January 6th.
"The FBI on Thursday arrested Federico Klein, a former State Department aide, on charges related to the storming of the Capitol on Jan. 6, marking the first known instance of an appointee of President Donald Trump facing criminal prosecution in connection with the attempt to block Congress from certifying President Joe Biden's victory," reported Josh Gerstein. "Klein, 42, was taken into custody in Virginia, said Samantha Shero, a spokeswoman for the FBI's Washington Field Office. Details on the charges against him were not immediately available."
"Klein worked on Trump's 2016 campaign and was then hired at the State Department," said the report. "As of last summer, he was listed in a federal directory as serving as a special assistant in the Bureau of Western Hemisphere Affairs and was designated as a 'Schedule C' political appointee."

WASHINGTON, D.C. A Mercer County mother of eight was indicted by a grand jury on charges related to her role in the insurrection at the U.S. Capitol on Jan. 6.
Rachel Marie Powell, 40, was indicted Thursday on charges including committing an act of physical violence in the Capitol grounds or buildings; obstruction of an official proceeding and aiding and abetting; destruction of government property; and engaging in physical violence in a restricted building or grounds with a deadly or dangerous weapon.
Officials said she appeared to have inside knowledge of the layout of the Capitol grounds and was instructing other rioters where to go and what to do.
Last month, a second federal judge denied a government motion to keep Powell behind bars, and she was released on house arrest. She was allowed to leave Pennsylvania only to attend court hearings in Washington, D.C.

St Cyr posted a picture of herself inside the building captioned, Patriots are in our house, as well as a video from the Capitol steps saying the rioters needed glasses and gas masks.
She also posted several livestream videos of the events in real time criticizing the Capitol Police for resisting the invasion.
Super sad that this is America, and Americans are being beaten for wanting to save their country, she says on one post, adding, So welcome to communist America.
Like many others arrested for participating in the riots, St Cyr also made several public statements about her participation in the events at the Capitol in the days after Jan. 6.
In a since-deleted Facebook Live post from Jan.7, St Cyr bragged about having made CNN (she was shown on the cable news network leaning out of a Capitol Building window and yelling this is our house).
God put me in that window, so Im assuming God put me on CNN screaming like a mad woman, St Cyr said, according to the Idaho Statesman. So hey, maybe Im going to get arrested again, but I would get arrested and I would die for this country. So no regrets.

The existence of such communications doesnt necessarily indicate wrongdoing by lawmakers and investigators arent yet targeting members of Congress in the investigation, the official noted. Should investigators find probable cause that lawmakers or their staffs possibly aided the insurrectionists, they could seek warrants to obtain the content of the communications.
