Garland's AG nomination delayed by GOP roadblocks

Merrick Garland's attorney general nomination is hitting GOP roadblocks that will likely delay his confirmation to lead the Justice Department until next week.
Sen. Tom Cotton (R-Ark.) a member of the Judiciary Committee viewed as a potential 2024 contender said on Wednesday that he is blocking an effort by Democrats to expedite Garland, whom they had hoped to confirm this week.
"Democrats are trying to expedite Judge Garlands confirmation vote. Im blocking them because Judge Garland has refused to answer basic questions, including whether illegally entering the country should remain a crime," Cotton said in a string of tweets explaining his opposition.
Under the Senate's rules, any one member can slow down a nomination and force Senate leadership to eat up days of time before a final vote.

(128,844 posts)which is often done for almost all of the lowest level appointees (like Regional Directors for agencies or even some U.S. Attorneys, etc).
So requiring a full debate and vote for a confirmation is really the "normal" process when it comes to the highest level appointees (Department/agency heads) and IMHO this type of reporting really is being disingenuous in the way "Regular Order" is being characterized by giving the GOP more attention and "power" than they really have by calling what Cotton is doing, "roadblocks".
The odds of passing ANY Department/agency head by "unanimous consent" (no matter who is President) is pretty much zero.

And between now and confirmation, it behooves to keep that court filled as long as possible since they are next in line for all the insurrectionist cases being handled by the lower D.C. District Court that might get appeals. Hopefully they have someone queued up to take over his judicial slot on that court.

VP is formally considered a cabinet position.

Why is a senator asking a judge nominated for attorney general whether the law on illegal entry should be changed?
Cotton doesnt even know how to ask an appropriate question
And Im still stuck figuring out whether to wake up and what to eat.

(215 posts)Judge Garland's job as AG will be to oversee the effective and equitable enforcement of laws that Congress has written and a president has signed. A senator with his education, a Harvard Law JD, should know that by now. Mr Cotton is merely grandstanding for the Republican base that he hopes to attract in his next election run.
