UPDATE: As of March 3, more than 300 defendants have been charged in federal court from 40 states. Of those, 87 were also indicted by grand juries, according to documents reviewed by CBS News: 26 Texans, 22 from New York while Florida and Pennsylvania each had 20.

CBS NEWS reports the following stats:
20 have been charged under a destruction of government property statute.
40 people have been arrested for assault on law enforcement officers.

A leader of the far-right group separately said he had been in touch with Roger Stone, but an official said it was not the same contact investigators found through electronic communications records.

WASHINGTON — A member of the far-right nationalist Proud Boys was in communication with a person associated with the White House in the days just before the Jan. 6 assault on the Capitol, according to a law enforcement official briefed on the investigation.

Location, cellular and call record data revealed a call tying a Proud Boys member to the Trump White House, the official said. The F.B.I. has not determined what they discussed, and the official would not reveal the names of either party.



The same data has revealed no evidence of communications between the rioters and members of Congress during the deadly attack, the official said. That undercuts Democratic allegations that some Republican lawmakers were active participants that day.




Although investigators have found no contact between the rioters and members of Congress during the attack, those records have shown evidence in the days leading up to Jan. 6 of communications between far-right extremists and lawmakers who were planning to appear at the rally featuring Mr. Trump that occurred just before the assault, according to one of the officials.

Former House impeachment manager Eric Swalwell has sued former President Donald Trump, his son Donald Trump Jr., Rudy Giuliani and Republican Rep. Mo Brooks in a second major lawsuit seeking to hold Trump and his allies accountable for inciting the insurrection at the US Capitol on January 6.

The new lawsuit filed on Friday by Swalwell, a California Democrat who helped to lead impeachment arguments against Trump for inciting insurrection, follows a similar suit filed last month by Rep. Bennie Thompson against Trump, Giuliani and the extremist groups the Oath Keepers and Proud Boys. Swalwell's case makes some of the same claims as Thompson's -- citing a civil rights law meant to counter the Ku Klux Klan's intimidation of elected officials.

But it also alleges Trump, Trump Jr., Giuliani and Brooks broke Washington, DC, laws, including an anti-terrorism act, by inciting the riot, and that they aided and abetted violent rioters and inflicted emotional distress on the members of Congress.

On MSNBC Saturday, former federal prosecutor Joyce Vance outlined the legal problems that the new civil suits against former President Donald Trump will create for him.

"These civil cases are a very interesting aspect of the search for accountability," said Vance. "We've seen the flawed impeachment procedure, which failed to hold him accountable despite evidence. We're looking at the criminal process and criminal investigations ongoing, too early to conclude whether that would ultimately reach former President Trump and his inner circle. These civil cases are a direct and potentially more quick route for the American people to gain the truth."

"Representative [Eric] Swalwell's complaint is particularly interesting because it raises claims under the Ku Klux Klan Act, which talks about interference with Congress' performance of official duties, and files suit in his individual capacity, arguing interference and interference with his well-being and the well-being of others," said Vance. "Only one of the claims in this complaint have to survive a motion to dismiss, an early preliminary motion that the defendants will file in order to begin the discovery process, and that's part of the legal proceedings in the civil case where a litigant like Representative Swalwell has the ability to take depositions to ask for documents where there's actually an obligation that the defendants respond under oath."

A Trump appointee, who was still employed at the State Department when he allegedly bashed police at the U.S. Capitol with a riot shield and egged on a crowd of insurrectionists...Federico Klein, a 42-year-old State Department staff assistant with top security clearance, is facing a slew of charges, including unlawful entry and assaulting an officer with a dangerous weapon, according to a criminal complaint first obtained by The New York Times.

Prosecutors allege Klein, who also worked on Trump’s 2016 campaign, “physically and verbally engaged with the officers holding the line” before assaulting one officer with a riot shield—and using that stolen police equipment to wedge open a door into the Capitol to allow insurrectionists inside.

“We need fresh people, need fresh people!” Klein, who is wearing a red MAGA hat, is heard yelling in a YouTube video as people stormed the building and police strained to hold back the crowd.

During his initial court appearance on Friday, Klein’s appetite for chaos had subsided. After Magistrate Judge Zia Faruqui read Klein his charges, Klein made it known he wasn’t happy about the conditions in a D.C. jail.

“I wonder if there’s a place where I can stay in detention where I don’t have cockroaches crawling over me while I attempt to sleep... I mean, I really haven’t slept all that much, your honor. It would be nice if I could sleep in a place where there were not cockroaches everywhere,” Klein said, according to The Washington Post.

The court papers obtained by The Washington Post detail Klein’s alleged conduct throughout the siege of the Capitol, tracing his apparent movements and actions from using a police shield to try to pry a door open, to calling for reinforcements from the crowd, to losing his red “Make America Great Again” baseball cap, looking for it amid the chaos, and then grabbing another red hat on the ground that turned out to be the wrong one.

Klein’s arrest is the most direct link yet between the Trump administration and the rioters, despite attempts by some conservatives to dissociate the insurrection from the former president. Many of the 300-plus people who have been charged in connection with the insurrection have described themselves as Trump supporters, while some have ties to extremist groups like the Proud Boys, which Canada has designated a terrorist group, and the Oath Keepers.

Klein, who is also a former Trump campaign employee, did not respond to a request for comment. A State Department spokesman said Klein served as a political appointee in the department from 2017 until his resignation in January. “This is being investigated by FBI, and they are the appropriate agency to answer questions specific to the charges,” the spokesman said.

Klein had a top-secret security clearance that was renewed in 2019, the FBI said. A LinkedIn profile the FBI identified as Klein’s also lists a top-secret security clearance and shows that Klein has been politically active in the Republican Party since at least 2008, when he began volunteering for political campaigns. Before joining the State Department in 2017, Klein worked for the Trump campaign, which paid him a $15,000 salary.

Klein was still employed at the State Department as a staff assistant on Jan. 6 when he joined a mob in a tunnel leading into the U.S. Capitol, the FBI said. Then he allegedly “physically and verbally engaged with the officers holding the line” at the building’s entrance, according to the complaint. After ignoring officers’ orders to move back, he assaulted officers with a riot shield that had been stolen from police, the complaint said, and then used the shield to wedge open a door into the Capitol.

HOUSTON – The FBI has arrested a fourth person in the Houston area in connection with the riot at the U.S. Capitol.

Shane Jenkins, 43, was arrested Friday morning at his northwest Houston home, according to the FBI. He now faces several charges stemming from the Jan. 6 insurrection that led to the death of five people, including a police officer.

According to federal court documents, Jenkins is charged with assault on a federal officer, obstruction of law enforcement during civil disorder, damage to federal property, disorderly and disruptive conduct in a restricted building or grounds and two counts of knowingly entering or remaining in any restricted building or grounds without lawful authority.

According to the criminal complaint, Jenkins was identified by someone who was researching people seen in public footage of the riot. According to the document, the person watching the video could see Jenkins pull out a “small crowbar” and smash a window near a tunnel in the Lower West Terrace of the Capitol.

According to the document, FBI agents found social media accounts belonging to Jenkins and saw photos and videos of himself at the riot that had been posted. Agents said that in the video, Jenkins can be seen using a hatchet to break a window in the Lower West Terrace area.

Eric Gene Barber, who was a former councilman for the city of Parkersburg, W.Va., was charged last month with restricted buildings or grounds, unlawful activities on Capitol grounds, and theft.

The FBI said Barber it identified Barber after witnesses flagged Facebook posts identifying Barber, as well as interviews he gave to The Parkersburg News and Sentinel and local NBC affiliate WTAP.

According to an affidavit, Barber was seen on footage from U.S. Capitol Police taking selfies in the Capitol Rotunda and “stopping at the C-SPAN media station located in Statuary Hall and searching through equipment that was on the stand.”

“BARBER appears to be looking at an item at the C-SPAN media stand. This video clearly depicts BARBER searching through items at the media stand, before appearing to unplug something and take it with him,” the affidavit reads. “Based upon BARBER’s activity at the stand, your affiant believed that BARBER took a portable power station from the media stand.”

The agent said he determined the identity of the C-SPAN fired service technician who was operating the media stand at the time. The individual said that two items were taken, a C-SPAN foldable stool and their individual personal power station used to charge an iPad.

Watkins has spent weeks working to portray Chansley as a harmless, well-meaning dupe, taken in by former President Donald Trump’s claims that the election was stolen and acting on the mistaken belief that the commander-in-chief was being truthful. He spent Friday’s hearing comparing Chansley to Forrest Gump, drawing attention to his hobbies as a painter and a potter and asserting that the “spearhead” attached to the pole Chansley wielded inside the Capitol was just decorative.

“I sang a song. And that’s a part of shamanism,” he said. “It’s about creating positive vibrations in a sacred chamber. I also stopped people from stealing and vandalizing that sacred space, the Senate. OK?”

At Friday’s hearing, Watkins asserted that Chansley’s eccentric style — he breached the Capitol shirtless, in a horned headdress, with ample tattoos exposed — underscore that he was not a leader of the violent charge but a happy-go-lucky follower. He committed no violence inside the building and prevented the theft of muffins from a Capitol break room, the defense attorney said.

Watkins also argued that video shows Chansley simply sauntered into the Capitol and was, in fact, invited in by the police. “Capitol Police are walking down the steps. There’s no barricade. There are no police lines and the police are saying the building is yours,” the defense lawyer said. “If you see my client’s horns, he’s just strolling up the steps. ... The door my client walked into is actually being held by a Capitol policeman.”

Lamberth seemed incredulous about that claim, saying he’d seen a photo on the front page of The Washington Post showing a Capitol window being smashed just as Chansley moved through a nearby doorway.

Bruno Joseph Cua, the Milton 18-year-old charged in connection with the insurrection at the U.S. Capitol on Jan. 6, wants to go home to his parents.

In a letter to U.S. District Court Judge Randolph D. Moss on Thursday, Cua begged to be reunited with his family as he awaits trial, promising “not to step one foot out of line.” Cua has been in custody since his arrest on Feb. 5, and has appealed an earlier court ruling denying him bond.

“I will never be the same person, jail has had its full effect me (sic), I am completely humbled, deeply remoursefull (sic) and regretful!” Cua wrote. “After all, thats (sic) what jail is for right? Teaching people a lesson? Lesson fully received, your Honor.”

Cua is the youngest of the more than 300 supporters of former President Donald Trump accused in the breach of the Capitol and, among Georgians charged, faces the most serious crimes. He is among just a handful of rioters who gained access to either the House or Senate chambers.

Prosecutors allege that Cua assaulted a federal officer while fighting his way to the Senate floor. He was photographed twirling a baton in multiple locations throughout the Capitol, joining the lawless mob that disrupted the counting of electoral college votes certifying the election of President Joe Biden. The charge for obstructing an official proceeding before Congress is punishable by up to 20 years, according to Cua’s attorneys.

Teenager, arrested in connection with Capitol riot, assaulted by fellow inmate, attorney says - NBC News




A teenager believed to be the youngest suspect arrested in connection with the U.S. Capitol riot was punched by a fellow inmate and has tested positive for Covid-19, defense attorneys said Monday.

The suspect, Bruno Joseph Cua, 18, is asking to be released from the Grady County Jail in Oklahoma, where he has largely been in solitary confinement since he was arrested Feb. 5, defense attorney William Zapf said in court papers seeking his pretrial release.

"Mr. Cua was assaulted and then threatened by a fellow inmate over this past weekend," Zapf wrote. "We understand that the inmate struck Mr. Cua in the face with his open hand, injuring his nose, over the use of the phone, and then threatened him regarding the incident."

On Saturday, a Covid-19 test for Cua came back positive, Zapf said. His attorneys argued that he is ready to safely self-quarantine, perhaps at a hotel, if he is released.



Paschall didn't address the allegation of an assault on Cua, who is from Milton, Georgia, while he was in custody. But she did cite the multiple photos taken of him during the Jan. 6 uprising at the U.S. Capitol, all appearing to show him without a mask.

Luke Coffee, 41, the actor grandson of 1960s TCU and University of Texas assistant coach Russell Coffee, thought he was going to Washington for the second coming — but not of Donald J. Trump.

Based on his own words, Coffee was among Capitol attackers who went not as Proud Boys or Oath Keepers, but as QAnon activists confusing religion and conspiracy, hoping to impose Christian rule and trigger the biblical second coming of Christ.

“A holy purge is happening, and it’s only from Jesus — it’s not from Donald J. Trump,” Coffee said over and over in videos, some still posted on social media.

He faces charges in connection with the assault of Washington, D.C., police officers with a crutch during the attempted overthrow.

Researchers at GWU's Program on Extremism analyzed the cases of 257 alleged participants the mob attack on the Capitol...divided the 257 individuals, who include 221 men and 36 women, into three groups: "militant networks," "organized clusters," and "inspired believers."

Militant networks, the report states, represent "the apex of organizational planning by domestic violent extremist groups for and on January 6th," and are "characterized by hierarchical organization and chains of command."

"Leaders of established domestic violent extremist groups issued orders or directives to members of their groups, encouraging them to travel to Washington in advance of the siege," the report states. "Unlike individuals in the other categories, not only did these militant networks plan to attend protests on the 6th, but they are also alleged to have planned in advance to breach the Capitol and, in many cases, conduct violence inside the walls of the building."

The second category, organized clusters, is "composed of small, close-knit groups of individuals who allegedly participated in the siege together, usually comprising family members, friends, and acquaintances."

"Finally, the remainder of the alleged siege participants can be categorized as inspired believers," the report says. "These individuals, according to available evidence, were neither participants in an established violent extremist group nor connected to any of the other individuals who are alleged to have stormed the Capitol."

GOP lawmakers are desperately trying to deflect blame away from Donald Trump and themselves.




The supposed siege of the president’s residence is the latest Republican deflection from the events of Jan. 6, when a pro-Donald Trump mob stirred up by Republican lies about voter fraud ransacked the U.S. Capitol.

Some Republicans, such as Senate Minority Leader Mitch McConnell (Ky.), have admitted what actually happened: “They stormed the Senate floor. They tried to hunt down the speaker of the House. They built a gallows and chanted about murdering the vice president,” McConnell said in February. “They did this because they had been fed wild falsehoods by the most powerful man on Earth ― because he was angry he’d lost an election.”

But others are compiling a growing list of distractions, excuses and alternate theories of the day’s events, hoping that as time passes, the public forgets what actually went on. Here are some of the ways Republicans are trying to deflect blame:

They’ve mined tens of thousands of photos and videos. They followed trails rioters left on social media bragging about being inside the Capitol, like the Florida man toting a rostrum or the New Hampshire man who snapped a selfie with a pilfered bottle of wine.

And they’ve arrested almost 300. But as many as 500 remain at large of the 800 who Capitol Police believe entered the Capitol. The riot claimed five lives and cost millions in damage and cleanup in the historic building.

Here’s what is known so far about the arrests:

Most people face charges that could send them to prison for anywhere from one to 20 years, but their trials could be delayed for months as the federal court system labors under the coronavirus pandemic.

An assistant U.S. attorney said in court last week that no plea offers have been made.

The FBI is expanding its online wanted gallery, with photos of more than 200 suspects, most of them wanted for physical violence against officers and the news media. The bureau shares it heavily on social media, hoping to keep those tips coming.

Dozens of other rioters have been identified after acknowledging being in the Capitol on social media or in interviews with journalists but haven’t been arrested.

The commanding general of the D.C. National Guard told lawmakers Wednesday that restrictions the Pentagon placed on him in the run-up to the Capitol riot and lag time in decision-making by his chain of command prevented him from more quickly sending forces to help quell the violence.

Maj. Gen. William J. Walker said his hands were tied by the Pentagon for more than three hours after he received a call from the Capitol Police chief saying a request for backup was imminent, delaying the arrival of military forces at the premises as lawmakers evacuated or barricaded themselves in offices during one of the biggest national security failures since the 9/11 attacks.

Walker described how he had troops ready and waiting to be sent to the Capitol but did not have sign-off from the Pentagon, which in directives ahead of the events had restricted his leeway to respond to contingencies.

Two-time Olympic gold medalist Klete Keller pleaded not guilty to seven charges on Tuesday for his alleged participation in the riots at the U.S. Capitol in January, according to USA Today.

Keller, 38, appeared in U.S. District Court in Washington virtually. He and his attorney declined to comment further, and he is next due to appear in court on April 6.

Keller indicted on 7 charges from riots
Keller was indicted on seven different charges from the Jan. 6 riots in Washington, including for knowingly and unlawfully entering and remaining in a restricted area, interfering with official government business, engaging in disorderly conduct to disrupt a session of Congress and interfering with law enforcement during a civil disorder.

He was recognized by an FBI agent due both to his height and the Team USA jacket that he was wearing at the Capitol. He also had several social media posts supporting former President Donald Trump before his accounts were disabled.

Keller turned himself into authorities in Colorado nine days after the riots, and was released without bond. He could face up to 15 years in prison.

The day after the Jan. 6 riot at the U.S. Capitol, an anonymous tipster from Finland alerted the FBI to a video on a Finnish newspaper‘s website. It showed a man with a bloody forehead outside the Capitol building wearing a black ballistic vest and an American flag as a cape.

“There were people scuffling with the cops, and that’s when I got hit with a projectile — not sure what it was,” the 33-year-old man, Kevin Cordon of Alhambra, told a U.S. correspondent for the Finnish publication Ilta Sanomat.

“And then from there, we proceeded into the broken windows and into the Capitol building. We were walking around the hallways, and the Trump supporters were all going nuts.”

On Tuesday, Cordon and his brother, Sean Carlo Cordon, 35, of Los Angeles, were arrested and charged with violent entry and disorderly conduct on Capitol grounds and other crimes stemming from the assault on the Capitol by Donald Trump supporters, authorities said. The mob broke into the building in an attempt to stop Congress from certifying Joe Biden’s victory in the presidential election.

A second member of the Oath Keepers militia who provided security to longtime Donald Trump adviser Roger Stone has been charged with storming and breaching the Capitol.

Joshua James, who has been seen in photos flanking Stone ahead of the Jan. 6 riot, was later seen on camera inside the building amid a crush of rioters who overran police.

Court records show James, 33, was arrested in his home state of Alabama on Tuesday and appeared before a federal magistrate judge in Birmingham. Prosecutors there asked that he be detained pending trial. A bail hearing was set for Thursday.

The arrest — made public a day after prosecutors revealed they had charged fellow Oath Keeper and Stone security guard Roberto Minuta for entering the Capitol — is the latest evidence that prosecutors are homing in on the extremist group with key ties to organizers of pro-Trump ”Stop the Steal” events. About a dozen Oath Keepers have been charged among the more than 250 Capitol rioters identified by authorities.

The filings also make no secret of the Oath Keepers’ connection to Stone, both linking to a New York Times article that described their connection to the Trump ally in the days and hours before the Capitol siege. Just before referencing that news article, the affidavit used to obtain an arrest warrant for James describes him as part of “a security detail for a speaker at the ‘Stop the Steal’ rallies and events.”

The founder of the Oath Keepers was giving directions before and during the US Capitol riot to alleged extremist conspirators among the right-wing paramilitary group, the Justice Department said in court filings Monday and Tuesday.

The new details begin to capture more about the leadership and network within the Oath Keepers around the insurrection, as prosecutors fight to keep defendants in jail and charge additional members of the group.

Monday night's filing highlighted newly disclosed communications over the messaging app Signal that investigators have found from Stewart Rhodes, the Oath Keepers' founder, and regional Oath Keepers leaders.

The Justice Department describes Rhodes as a central presence among the Oath Keepers during the siege, telling some where to go and gathering with them in person at the Capitol.



Prosecutors have gradually been building out a major Capitol riot conspiracy case against nine Oath Keepers. The new details about Rhodes, which come in arguments to keep another alleged Oath Keeper who was arrested early in the investigation in jail, is the first time the Justice Department has offered a bigger picture of directions given that day and shared publicly what they've learned about the involvement of the Oath Keepers' national leader. Before this week, nine Oath Keepers from different states had been charged in a conspiracy case.

Using several tips that included images and posts from Facebook and body camera footage from police, the FBI on Tuesday announced the arrest of Troy E. Sargent of Pittsfield in connection with the insurrection at the U.S. Capitol on Jan. 6.

Through video images captured during investigation, authorities identified Sargent and said he not only participated in the violence, but appeared to throw a punch at a U.S. Capitol Police officer at the federal building in early January.

Sargent is scheduled for for a remote court appearance in a Springfield federal court before Magistrate Katherine A. Robertson on Tuesday.

He is charged with forcibly assaulting, resisting, opposing, impeding federal officers, obstruction of law enforcement during civil disorder, knowingly entering or remaining in any restricted building or grounds without lawful authority, knowingly engaging in disorderly or disruptive conduct in restricted building or grounds, knowingly engaging in physical violence in restricted building or grounds and willfully and knowingly engaging in physical violence in capitol grounds or buildings.

According to court documents, the FBI received two tips on Jan. 11 that Sargent participated in the insurrection at the U.S. Capitol. Each submission included a photograph that has since been removed from social media of Sargent in front of U.S. Capitol police in riot gear.

Republicans looted our Capitol to the tune of $30,000,000.
They killed 5 Americans, blinded another and seriously injured scores of others.
Republican urine & feces, along with American blood, had to be cleaned from our Capitol.

"The [inauguration] platform was wrecked. There was broken glass and other debris. Sound systems and photography equipment was damaged beyond repair or stolen. Two historic Olmsted lanterns were ripped from the ground, and the wet blue paint was tracked all over the historic stone balustrades and Capitol building hallways."

In the Capitol building complex, historical statues, murals and furniture were damaged, mainly from pepper spray accretions and residue from chemical irritants and fire extinguishers, requiring expert cleaning and conservation. Work crews covered gaping holes with plywood and cleared "a small mountain of debris left behind on the west and east fronts," Blanton said.

Blanton also said many lawmakers have asked his office about preserving mementos from the unprecedented violence wrought by U.S. citizens on their own Capitol. While most damaged items had to be removed because of safety concerns, he said his staff preserved the panels of the historical Columbus Doors on the east front "for a potential presentation or display."

Pramila Jayapal (D-Wash.) called for ethics probes into Reps. Lauren Boebert (R-Colo.), Mo Brooks (R-Ala.), and Paul Gosar (R-Ariz) and their "involvement" in the January 6 Capitol insurrection.

"Five minutes after insurrectionists first breached the Capitol, Representative Boebert tweeted from inside the House chamber, 'We were locked in the House chambers' at 2:17 pm," Jayapal wrote (pdf), detailing just one of several examples. "She then tweeted a minute later, 'Speaker has been removed from the chambers.' She was one of only two members, the other being Representative Mo Brooks (Ala.), who tweeted the location of Speaker Nancy Pelosi."

As the Washington Post reported days after the January attack, Reps. Steve Cohen (D-Tenn.) and John Yarmuth (D-Ky.) recounted that they both witnessed Boebert "with a 'large' group in a tunnel connected to the Capitol days before the attempted insurrection that left four rioters and one police officer dead."

"We saw Boebert taking a group of people for a tour sometime after the 3rd and before the 6th," said Cohen. "Now, whether these people were people that were involved in the insurrection or not, I do not know."

A Marine Corps veteran charged in the Capitol riot once served as a crew chief for the presidential helicopter squadron, a highly restrictive unit that requires a top-secret security clearance, officials said Wednesday.

John Daniel Andries, 35, of Piney Point, Md., was arrested last month and charged with two felonies, including violent entry and disorderly conduct on the Capitol grounds. He pleaded not guilty, WUSA9 reported. His attorney did not immediately return a request for comment.



The squadron, also known as HMX-1, oversees presidential travel aircraft. The helicopter is known as Marine One when the president is aboard. The squadron’s other role is testing and evaluating helicopters.

The squadron’s members must receive a top-secret clearance and receive a special higher-level clearance known as Yankee White, officials said, which is reserved for personnel close to the president.



Andries, in a tan jacket, was recorded in several parts of the Capitol, according to a criminal complaint. Standing near a group of police at one point, he waved to other members of the crowd, appearing to draw them closer to the confrontation with the officers, according to a video cited by prosecutors.

A North Alabama man whom federal agents say participated in the Jan. 6 riots at the U.S. Capitol has been charged with two counts in connection with his alleged role, according to an indictment unsealed Tuesday.

Joshua James, 33, of Arab, had contact with the Oath Keepers, a far-right militia group, before the Jan. 6 riots and congregated with them inside the Capitol when the building was breached, according to an affidavit from an FBI special agent filed in D.C. Circuit Court.

The day before the riots, James served as security for one of the speakers at a “Stop the Steal” rally in D.C., according to the affidavit. Photos showed James wore clothing with an Oath Keepers patch on Jan. 5 and Jan. 6.

James was also pictured standing with other Oath Keepers, including Kelly Meggs, the self-proclaimed leader of the Florida Oath Keepers who was also charged with storming the Capitol, during the riots, the FBI agent claimed.

Phone records showed James was in constant contact with one of the Oath Keepers on Jan. 5, exchanging six calls with the undisclosed member that day, according to the agent. James was also in contact with members on the morning of the riots, the agent alleged.

Former Acting Secretary of Defense Chris Miller told VICE on Showtime he believes Trump's speech caused the violent mob to attack the US Capitol on Jan. 6.




One of the most senior Cabinet officials in the Trump administration, Acting Secretary of Defense Chris Miller, has told VICE on Showtime that he believes the speech made by former President Donald Trump on the morning of January 6 was responsible for causing the mob to violently attack the Capitol later that day.

Trump installed Miller after firing his predecessor Mark Esper in the days after the election. Speaking exclusively to VICE on Showtime, Miller said, “Would anybody have marched on the Capitol, and tried to overrun the Capitol, without the president’s speech? I think it’s pretty much definitive that wouldn’t have happened.”

“This is a criminal enterprise,” Trump told the crowd in a 70-minute speech on January 6, referring to the election. “And we fight. We fight like hell. If you don’t fight like hell, you’re not going to have a country anymore.” Hours later, members of the same crowd were rampaging through Congress to stop lawmakers from certifying the results.

Recalling the events of that day, Miller said he wasn’t sure whether Trump was aware that his speech might have such extreme consequences, but he was certain the attack wouldn’t have happened without them. Listening to the remarks that morning, he said he found some of the comments “concerning” and that they set off alarm bells.

“It seems cause-and-effect,” Miller said, referring to Trump’s speech and the violent riot that left five people dead. “The question is, did he know he was enraging people to do that? I don’t know.”
