That asshole Tom Cotton had a hold on Garland's nomination. After an all night session on the COVID recovery act, the GOP left the Senate which allowed to Schumer to pass to pass a couple of resolutions cutting off debate on Merrick Garland.

(51,282 posts)The original intent of these sections was to protect a senator's right to be consulted on legislation that affected the senator's state or in which a senator had a great interest. The ability to place a hold would allow that senator an opportunity to study the legislation and to reflect on its implications before moving forward with further debate and voting.[2]
According to Congressional Research Service research, holds were not common until the 1970s, when they became more common due to a less collegial atmosphere and an increasing use of unanimous consent to move business to the floor.[3]
Holds, like filibusters, can be defeated through a successful cloture motion. However, the time required to bring around a cloture vote often allows fewer than 40 senators to block unimportant legislation when the majority is not willing to force the vote. The countermeasure to excessive holds may be increased determination on the part of the leadership to bring up measures despite holds, but the delay involved in cloture votes constrains the leader's ability to do this.[4]

(26,731 posts)Not just because Garland had the votes all along... but because all Cotton could do was deny unanimous consent... which cant keep the nomination from coming to the floor... it can only delay it by about a week. Thats why the articles talking about Cottons actions called it a delay rather than blocking... and said that the earliest the vote could occur was the next week.

(26,731 posts)You either have unanimous consent to proceed outside the normal process... or you have to follow the normal process. It isnt a delay that each senator can evoke in series... its either unanimous or it isnt.

A tag-team hold is when two or more senators agree to circumvent a 2011 resolution limiting secret senate holds to two days.
One senator will inform his party leader of his intent to place a hold. Before two days pass, the senator will withdraw his hold, at which time his tag-team partner submits a new hold request. The senators rotate in this manner, and the identity of neither is revealed.

(26,731 posts)There is no 2/3 cloture threshold. This has nothing to do with some clever strategy by Schumer. All Cotton could do was delay the confirmation by about a week and thats what occurred.
