Setting up a potential showdown over transgender rights, the White House has cautioned states seeking to pass discriminatory legislation in 2021.
On Friday, White House Secretary Jen Psaki was asked about the bills introduced in more than two dozen states this year seeking to deny health care, educational opportunities, or birth certificates to trans youth and adults. Within the past week, Montana, Alabama, and Tennessee have all advanced such proposals, while Mississippi is on the verge of signing a bill banning trans female students from playing on womens school sports teams.
In comments to the Washington Blade during a press briefing, Psaki reiterated the administrations support for full trans equality, which was affirmed in a day-one executive order signed by President Joe Biden instructing the government to investigate discrimination claims on the basis of sexual orientation and gender identity.
The president believes that trans rights are human rights, and that no one should be discriminated on the basis of sex, she told the LGBTQ+ newspaper, adding: Not only is this the law of the land, its his own deeply held view.

To be more specific, I really don't know that the current 6-3 makeup of the SCOTUS is going to see it that way if this idea is put to the test.
I believe we need to explicitly codify a Federal ban on discrimination based both on sexual orientation, and gender identity. And we should definitely do it QUICK, while we have a chance to do so.
The White House seeming to hold the opinion that it's currently/already 'the law of the land' I have to say ... alarms me a bit.
I don't doubt that Joe's administration would try to protect trans rights when the rubber hits the road, but I don't know that the SCOTUS would come down on their side.
