A teenager believed to be the youngest suspect arrested in connection with the U.S. Capitol riot was punched by a fellow inmate and has tested positive for Covid-19, defense attorneys said Monday.
The suspect, Bruno Joseph Cua, 18, is asking to be released from the Grady County Jail in Oklahoma, where he has largely been in solitary confinement since he was arrested Feb. 5, defense attorney William Zapf said in court papers seeking his pretrial release.
"Mr. Cua was assaulted and then threatened by a fellow inmate over this past weekend," Zapf wrote. "We understand that the inmate struck Mr. Cua in the face with his open hand, injuring his nose, over the use of the phone, and then threatened him regarding the incident."
On Saturday, a Covid-19 test for Cua came back positive, Zapf said. His attorneys argued that he is ready to safely self-quarantine, perhaps at a hotel, if he is released.
Paschall didn't address the allegation of an assault on Cua, who is from Milton, Georgia, while he was in custody. But she did cite the multiple photos taken of him during the Jan. 6 uprising at the U.S. Capitol, all appearing to show him without a mask.

I can think of two reasons why he may have been punched: 1) Because he's a stupid asshole who probably was mouthing off and got what he deserved
or
2) Offered to pay the cellmate if he punched him to get sent home because his cellmate is a meanie.
Either way, I love the judge's response.

(33,643 posts)and 'conservative principles' don't enter into the situation. Jail is a fair consequence, but getting beaten up in jail (or worse) ... is not.
While at the same time I really don't think that the judge in a pre-trial situation should 'care' that a defendant got their ass kicked while in jail.
For one, it's up to the warden to manage the inmates, but secondly, it is an irrelevant matter WRT the persons innocence or guilt.

(65,010 posts)A little more nuance would suggest that the easiest way to avoid prison violence is to avoid the behavior that landed him in jail.
I'm for disciplining the inmate that struck him, but I'm having trouble feeling sympathy for a seditionist punk who could have just stayed home; to where he's now pleading to return.

(17,003 posts)He made bad choices and ended up where lots of other adults who make bad choices end up. I dont condone violence anywhere including jail but to think he should be released because of it is just over the top.

Rather than throwing him in prison , maybe it would be better to send this kid to boot camp?
Community service?
He has lousy parents.
He didnt engage in any violence
He didnt have any firearms
Lets show some compassion for him.
