7. ⭐⭐ Explanation of "superseding" indictment... ⭐⭐
Fri Mar 19, 2021, 04:17 PM
Mar 2021
https://www.burnhamgorokhov.com/criminal-defense-resources/federal-criminal-process/federal-indictments-faqs/

Can the indictment be amended (changed) to charge different or new crimes?

Technically speaking, an indictment cannot be “amended” once it has been returned by the grand jury, because that would violate the defendant’s Fifth Amendment right to be indicted by a grand jury. However, it is also true that prosecutors do frequently alter the crimes charged, or even add new charges, during the course of a criminal proceeding.

Prosecutors accomplish this by filing what is called a “superseding” indictment. A superseding indictment is just like any other indictment, and it must be obtained the same way as the original indictment—through a grand jury. The superseding indictment can include different charges, new charges, or add new defendants. Once the grand jury returns a superseding indictment, the superseding indictment replaces (supersedes) the original indictment.

Potential sentences? Very long.

But let's back up.

What's a sentence? A sentence is a punishment defined after a defendant is CONVICTED.

Gotta' convict these people first OR strike a plea bargain.

IMHO...

Just my opinion...

I think around 1/2 the arrested will get the customary punishment given to other Capitol disrupters meaning little to no jail time, maybe a fine. These will probably be the folks who agree to plead guilty and check in for a couple weekends in jail.

I think the other half will either be brought to a trial or they will refuse the plea bargain.

This is where it gets interesting.

Change of Venue requests, paid Jury Consultants...

ONE Trumpist on the Jury and it's hung...

If I had to bet...

50% walk with little to no punishment

40% plea to something or are found guilty in Court, spend less than 30 days in jail.

10% are taken to trial for assault, conspiracy and the other "heavy" indictments.

And I think 3/4 of those will see jail times of 3 years +

About 25% of the trials will probably end up hung.

Bottom line, expect around 30 people to do real time.

As per usual LEO routine... they want to say to these clowns, "You're looking at 30 years, sign on the dotted line for 10."

Believe it nor not... the DoJ doesn't want to try too many of these people.

Between change of venue requests and Jury selection, the chances for an embarrassing outcome are high.

People are commenting on the hell these assholes will face in prison.
The strongest most United White Supremacy Gangs reside inside the bars. They will be welcomed and find instant protection with fellow assholes.
“IF” they get time, it will be short lived and they will return as hero’s and have even more warped perception of what they believe now. We may flood the streets in 5-10 years with these hero’s to their peers and be just a little more full of hate and lead more to kill, for the cause.
Proud boys and hard core assholes will be fine, but yea maybe some of these lawyers, police, and business men may not have such a good experience. And LEGAL gun ownership will not be as easy as getting a gun in the AM and slaughter minorities in the PM.

If that doesn't scare the beejeeessssuuuussss outa you, nothing does.

I keep wondering what they would have done if they would have been successful. Or would they have turned the running of the country over to the Mercers and the rest of the richie riches.

Then, what would they have done to we "liberal" "democrats" "progressives" ? That scares the hell outa me.

There's no clear beard meaning out there beyond religious ones. It's both a generational aesthetic and a personal choice, usually moreso in winter.

My son is one, partly out of winter cold, partly because it makes him look older in a western town where he has to get standing with 'outsider' men, partly because he's lazy and partly because he doesn't want a steady girlfriend. I hope he changes his mind, but then, it's his life. Beards have consequences, right? And
