Gaetz was/is actually under investigation, likely tied to the idiot tax collector friend. McGee gets wind of it through leaks from his old DoJ contacts, and approaches the Gaetz soliciting legal services. The Gaetz's, sensing that the improper leak is an escape hatch from this giant crashing airplane, try to get McGee jammed up on it, with the side benefit of muddying the water with FBI involvement.
Of course, the thing that won't budge is the underlying investigation/facts of his misconduct. They're trying to switch it to DoJ misconduct through McGee, then his leak source.
