Zellner Produces New Witness In STEVEN AVERY (Making A Murderer) Case.

Fodder for those interested in the 2005 Steven Avery case.

The New Development:
Steven Avery's defense attorney, Kathleen Zellner, added a BOMBSHELL affidavit to her appeal for a new trial for Steven Avery today. The affidavit is from a 'paper boy' who, while delivering newspapers to the Avery Salvage Yard in the predawn hours of Nov. 5th, 2005, said he ran into Bobby Dassey and another unknown man (50 or 60 years old, with a long grey beard) pushing Teresa Halbach's Toyota RAV 4 onto the Avery salvage yard.


The Background Story:
(For those of you who missed the Netflix series' Making a Murderer, parts I and II.)

--Steven Avery was wrongfully convicted of rape in Manitowoc County Wisconsin in 1985, and spent 18 years in prison before being exonerated by DNA evidence in 2003.

---After his release he filed a $36 million lawsuit against the Manitowoc County Sheriff's office, claiming that they railroaded him into a false conviction, inspired by local law enforcement's hatred of him.

--On October 31st, 2005, just before the law enforcement officials were to be deposed for the lawsuit, a woman (Teresa Halbach) who was a photographer for Autotrader disappeared after visiting Steven Avery at the family's auto salvage yard to take pictures of a van that Avery's sister was selling.

--On Nov. 5th, Teresa Halbach's Toyota RAV 4 was found on the Avery Salvage Yard, with smears of Teresa's blood found in the back, and smears of Avery's blood on the dashboard in the front. Bone fragments believed to be from Teresa were also found in a burn pit behind Avery's house trailer.

--In desperate need of money to hire a good lawyer, Avery negotiated a pathetic settlement of the $36 million lawsuit, to accept a mere $400,000; which he blew on his legal defense.

--Despite hiring expensive lawyers, Avery and his nephew Brandon were convicted of Teresa's murder in 2007.

--Defense attorney Kathleen Zellner took over Avery's case after his conviction, and has filed an appeal to have Avery's case re-tried on the grounds of new evidence. (Including evidence that the Prosecution had withheld from the Defense in the first trial.) Zellner offered many alternative suspects for the murder, including Bobby Dassey, who is Brandon's older brother. Zellner offered the alternate scenario that Bobby Dassey had murdered Teresa, planted her RAV 4 on the Avery property, and planted his uncle Steven's blood on the dashboard, which he obtained from Steven's bathroom sink after Steven had cut his finger. Bobby Dassey was also the Prosecution's main witness in convicting his uncle; and some of the evidence that would have pointed the finger at Bobby as the murderer is the evidence that was withheld from the Defense.

If true, the new affidavit wouldn't necessarily provide evidence that Bobby Dassey committed the murder. But it would certainly suggest he planted Teresa's RAV 4 on the property, and possibly the blood as well.

The 'paperboy' claims that he informed both the Manitowoc County Sheriff's Office, and Avery's first legal team about what he'd seen, but neither followed up with him. Hence the reason for this just coming out now. Although, I'm sure the timing of this affidavit will be called into question.

Sounds like he killed his nephew Brandon
