The burden of proof is on the prosecution.

They probably won't be able to prove or disprove intent. But they can prove or disprove poor training and lack of suitability for the job.

As a nurse, had I ADMITTED to witnesses present that I gave a patient the wrong drug and the patient died, you can bet I would have been drug test and arrested at the scene. No such accountability if you are a cop. I wouldn't have been allowed to resign and keep my pension either.
