(11,692 posts)One more in a litany of crazy rulings in the last 20 years. That is the reason 13 is a lucky number.
The Supreme Court ruled by a 5-4 margin late Friday that California's coronavirus-related restrictions on gathering in private homes violated constitutional rights on the free exercise of religion, the latest ruling from the high court that prohibits authorities from enforcing limits on religious services.

Is it political? Maybe, but who f-ing cares at this point.

(15,696 posts)I think there should be at least 15 circuits, more appropriately 17, with SCOTUS expansion to match.
With court expansion, backlogs of trials and cases could be addressed more effectively, as well as balancing the mix of judges.
Just think of how many judges Biden could appoint by adding 2-4 new circuits...

(16,139 posts)13 is a good place to start because a non-political argument can be made for it.

"UPDATE: Biden unveils commission to study possible expansion of Supreme Court"
Source: Washington Post
"President Biden created a bipartisan commission Friday to study structural changes to the Supreme Court, giving the group 180 days to produce a report on a range of thorny topics including court expansion and term limits. The commission, composed of 36 legal scholars, former federal judges and practicing lawyers, fulfills Bidens campaign promise to establish such a group after activists pushed him to back expanding the court after Republicans rushed to confirm Justice Amy Coney Barrett shortly before last years election. Biden has said he is not a fan of adding seats to the Supreme Court, but he has declined to say whether he supports any changes to its structure."

(12,494 posts)And magically Manchin/Sinema voted for it... AND eliminated the filibuster...
I wouldn't be surprised to see a 9-0 SCOTUS somehow find it unconstitutional.

(12,494 posts)At Harvard last week Breyer straight up warned Democrats against it and Sotomayor decried the partisan tone in the country in a joint appearance with GoodHair.
Oh and this is "Dead Bill Walking"
Manchin and Sinema are against it and certainly wouldn't kill the filibuster for it.
Remember when the GOP House passed ObamaCare elimination 43 times? That's called legislative masturbation.

(5,009 posts)The court is currently 6/3. If four more seats were added and IF they were all progressive, that would create a 7/6 SCOTUS. It leaves too much tension for selections to the court in the future. Put it out of reach of the cons for a good amount of time with an increase to at least 15.

(3,282 posts)It doesn't have anywhere near enough support to get through congress. It may not even be able to make it out of the House.

(3,586 posts)So I grow weary of hearing other Democrats worry about what Republicans would do if we expanded the Supreme Court to 13 or 15. They've already packed the federal courts with unqualified jurists, and Democrats are still letting the fascists frame the future debate.
