It's more whether the use of force was unreasonable. If jurors determine the use of force was reasonable and thus authorized, they can't convict. All the defense needs to do is create a doubt around that point.

That judge, appointed by a Republican governor, with a track record of donations to Repubs, had no business being on this case. He dared agree with the defense that Maxine Water's comments could be grounds for an appeal.

All the thousands of items of press coverage and the judge thinks one Congressperson's comments could be grounds for appeal? What a tool.
