(115,693 posts)or it's considered to be waived on appeal. He's making sure his butt is covered, because if Chauvin is convicted - and he probably will be - he is certain to appeal.

(16,216 posts)But it sounds to me the defense lawyer has been whining a lot thru out this trial. Hes seems to be setting up a situation for appeal..which is expected, I think, but the judge does not seem impressed

(115,693 posts)I'm a retired lawyer, and I worked in the county where this trial was held. There was nothing at all unusual about this one except for its high profile, the fact that it was televised, and the covid procedures. It was by the book, and that's what the book looks like.

(115,693 posts)as to how trials work in the real world as opposed to on TV. The defense lawyer has been doing exactly what he had to do. He has a crap case with bad facts for his client, so he was reduced pretty much to squirting out a cloud of legal squid ink; if you know you aren't likely to win you have to try for damage control. But that's how it works.

(18,654 posts)There was a plea deal, 10 yrs for 3rd degree murder. It was nixed by Barr because it involved no Federal charges.
Without the deal, they must have felt the chances were better with a jury than a guilty plea.
