Snip
As Abreu started filling out the purchase forms, the worker brought over the pistol and explained what came with the gun, police said.

When he mentioned the gun came with both a six- and eight-round magazine, Abreu is accused of replying: “Man, that’s fine, I got eight rounds to kill eight people today.”

The worker explained to Abreu that he couldn’t sell him the pistol after making that kind of comment and contacted his manager to explain the situation, police said....

“He does have a prior felony conviction which under state law prohibits him from possessing a firearm,” Victoriano Flores, a Harris County assistant district attorney, told KPRC.

Presumably the background check had been completed by the time he was making a purchase.

Or does that come after he buys it, but before they give it to him? Isn't there a waiting period, even in TX?

I guess next time he wants to buy a gun, Mr. Abreu will apply the lessons learned from this time around.

they'll go to an FFL and consummate the transfer legally. Unfortunately, few gunners are as responsible as they want us to believe.

They don't care who they sell guns to. And neither does the law, thanks to Republicans and the NRA.

If you make a living selling guns then you must have a federal license and background checks are mandatory. Nowadays most gun shows will only allow licensed dealers due to insurance requirements.

selling guns and, thus, don't need to have a federal license or do background checks.

If someone wants to buy a gun without undergoing a background check, the best place to do it is at a gun show where they can find unlicensed dealers who sell guns as a "hobby."

Private sales can only be between residents of the same state while in that state. If someone sells guns for a living then they need a license to sell at a gun show. "Unlicensed " dealers are despised by legal gun dealers and are turned into the ATF by legal dealers all the time. Gun shows are also crawling with ATF agents and cops so every dealer is closely scrutinized.

The solution to private sales is Universal Background Checks which require background checks for all sales.
