BREAKING: Federal judge orders the release of 1/6 rioter Richard BARNETT, who left Pelosi a menacing note and took pictures at a desk in her office.

Judge Chris Cooper has ordered Barnett on home confinement instead. He says prosecutors fell short of evidence for detention.

Cooper cited the recent appeals court decision that led to release of Zip-tie Guy Eric Munchel. That ruling raised the bar for detention cases to require specific evidence of a future threat of violence.

Prosecutors didn't met that standard, Cooper said.

The prosecution did not meet the burden of proof to warrant his continued detention.

It doesn't mean he can roam the streets freely. He is ordered under house arrest. It means that while he awaits his trial, he will have monitoring and have to check in with pre-trial services.

Just because something happens that we don't necessarily like, doesn't mean that there is something nefarious going on. our court system is skewed toward the rights of the accused. Now, that doesn't mean that it is applied equitably, but that is jurisprudence in the US.

People who were active participants are being let go even though they not only took part in the violence but threatened to return, and the excuse given for letting them go is that the electoral vote count is over. The Capitol and those who work there are still a target by these fucking crazies. Someone is missing the point here. These people are dangerous, they have acted in a reckless and dangerous way, a police officer died. People in the crowd died, an officer had to discharge his weapon to protect members of Congress and we are letting these dangerous insurrectionists out of jail.

What the actual fuck is going on here.

There is plenty of visual evidence of what he did. He'll be found guilty. We'll see how harsh the sentence will be. I hope it's not just probation but actual jail time.

My guess is that he called it as he saw it, and gave deference to a prior ruling by an appeals court.

I just hope that when the asshole seditionist inevitably violates the terms of his bail, the judge comes down on him with both feet!

It's for protection of basically society, or at least specific members. It's the prosecutions job to demonstrate that he was a FUTURE threat prior to trial. Apparently they couldn't make that case (probably a lack of prior convictions). So many of the other insurrectionists had already been put on house arrest, I suspect the "bar" on keeping them in jail is getting too high that it becomes harder for the prosecution to make the case for pre-trial detention.

If it helps, this just reduces the "time served" and so lengthens the time he'll actually serve.

Protection of society. Members of the Speakers staff literally hid under a table in fear for their life while that armed asshole sat armed with a stun gun feet from where they were hiding. He is a danger, he went to the Capitol on 1/6 ARMED . I dont care who appointed this judge, this asshole belongs behind bars while awaiting trial to protect the people who work on the hill A police officer was tazed and dragged into the crowd, he had multiple strokes because people like this came to the Capitol ARMED WITH WEAPONS and ready to do harm AND THEY DID!.

Very few of these jackholes should be held until trial, and this guy isn't one. Bullhorn Lady and Riley Williams are flight risks and should have been.

"Bigo" will serve time and have felonies on his record. This OBAMA judge did the right thing.

And he's going to push that "home confinement" order to the limit. Is going out to purchase groceries part of being confined to his home? How about going out to get a couple of gallons of gas for his car to be able to drive to the grocery store? Is having a bunch of your fellow insurrectionists over to your house for a beer part of home confinement?

People have a right to prepare for trial at home unless they pose an imminent threat of harm to others or themselves, or a flight risk.
