technically I guess you could try to have the Supreme Court dissolve West Virginia as being a state that is unconstitutional, but good luck in trying to find someone with standing to sue.

It likely was illegal but the answer that SCOTUS gave was basically shut up you were rebelling at the time (it was VA which sued to get at least part of the land back).
