Donald Trumps attorney defended the ex-Presidents incendiary speech on January 6, saying he is protected under the First Amendment and had absolute immunity while he was President to contest the election, CNN reports.
Trump argues in DC District Court that his bully pulpit message to his supporters at the political rally on January 6 encouraging them to oppose Congress certifying the vote was a constitutionally protected act of the presidency.

I'm not a lawyer, but I'm pretty sure Trump didn't have the right to go against the Constitution by trying to stop EC certification by sending a mob to the Capitol.

(2,740 posts)Does it give a sitting President the power to "contest and election" and "oppose the certification of the vote". Its not there. There is no such power or right. The Constitution spells out specifically how the electoral process works - and there is no contingency for the sitting President to encourage citizens to oppose The Constitution.
Ignorance is no argument here. Donald Trump can't argue that he did not intend on what we saw - destruction and death as an attempt to stop the electoral count. This is because there was no way to "oppose" the electoral certification from a Constitutional standpoint. Therefore, the only thing Trump could be encouraging the crowd to do was lawless.
There is NO reason he should not have already been charged with inciting violence. A local Antifa-type has already been charged, tried and convicted of "inciting violence" here in Tallahassee for simply calling on people to stop Trump supporters from storming The Capitol if they tried. There was no violence. But he was charged, tried and convicted. For inciting violence that didn't happen. Didn't even make national news.

(12,004 posts)As an attorney, you have an ethical obligation to zealously represent your client within the bounds of the law, and the ethical rules. When your client comes up with a dumb ass argument, and tells you to make it, you have an ethical obligation to refuse, and explain why you cant do what they want. If they insist, you have to fire them as a client, and withdraw from the case if it is pending in court. And yet these fools keep arguing absolute immunity, which does not exist.
Justice matters.

Where did he position himself?
Who was he with?
Why are there no pics of him while the Capitol was being breached? Did he prevent any media coverage after his speech? If he did - why?
We've heard that he was glued to a TV watching the 'Capitol carnage'.
During that period didn't McCarthy talk to him?
Who else might have talked with him?
Why do we have so little info about that period of time after his speech to the crowd on 1/6/2021?
Where was the MSM? Why aren't they asking these questions?
This needs to be investigated?
Was he directing the coup?
Ben Sasse was saying that the former was gleeful watching the attack on our Capitol.
Who did he hear that from?
How did he know that?
Who was in the room with him as he was watching it on TV? His kids were there before and during the speech. Was Rudy there? Was Michael Flynn there? Where were the other speakers that addressed the crowd that day?
How many people tried to get him to stop the rampage? Did anybody try to get him to stop the rampage?
What about any pre-planning for this Capitol breach/insurrection? Who was involved in these pre-planning meetings? I recall Roger Stone being at the Tr**p Hotel the day before? Who was he with? Who else was present? Were the former's kids there?
There are many questions that need to be answered. These above are just a few of them.
Put everybody that was with him in front of a 1/6 commission.
He doesn't have 'absolute immunity' for his actions - during the actual Capitol breach. He was Commander-In-Chief. He had the responsibility to protect the Capitol. He should have immediately taken action to stop it. Instead he watch it unfold on TV and I believe he pulled the plug when he knew that this coup was going to fail. He needed to make it look like he cared. And guess what - he wasn't successful at doing that either.
