On Wednesday, the defense attorney for ex-Minneapolis police officer Derek Chauvin asked for a downward sentencing departure for his client.
Documents filed in Hennepin County court propose probation and prison time equal to the time Chauvin has already served instead of the sentencing he is facing.
Chauvin was charged and convicted of second- and third-degree murder charges, as well as a second-degree manslaughter charge. He is scheduled to be sentenced on June 25.
"...the court must look to the facts. They all point to the single most important fact: Mr. Chauvin did not intend to cause George Floyd's death," the defense claimed in the filings submitted Wednesday
Has anyone ever received time served plus probation for a murder conviction?

(7,593 posts)Minnesota's sentencing guidelines call for a sentence length of 128-180 months, with two-thirds of that sentence being imprisonment and the remainder being supervised release.

(130,533 posts)It doesn't matter whether Chauvin intended to kill Floyd. He was convicted of second-degree felony murder (the killing of a person while committing another felony - aggravated assault), third-degree murder (killing that resulted from an act of depraved indifference), and second-degree manslaughter (acting negligently with the knowledge that death could result). None of these charges require intent to kill.
Probation and credit for time served? Seriously? He'll be lucky if he doesn't get an enhanced sentence.

(130,533 posts)12 years is the presumptive sentence under the sentencing guidelines, but the judge can deviate either downward or upward. I think pigs will fly before there is a downward deviation.
