(94,084 posts)"In this case, the subpoena, which was issued by a federal grand jury and included a nondisclosure order signed by a federal magistrate judge, provided no information on the nature of the investigation and it would have been virtually impossible for Apple to understand the intent of the desired information without digging through users' accounts," Apple said in the statement. "Consistent with the request, Apple limited the information it provided to account subscriber information and did not provide any content such as emails or pictures."
The subpoena was signed by prosecutor Jocelyn Valentine and authorized by Magistrate Judge Deborah Robinson in DC federal court, the source familiar with the request said.

Perhaps the judges should be heavily questioned as to why they approved these w/o apparent cause? Totally illegal I suspect being the Constitution does limit intrusions into everyday American lives via unreasonable searches and seizures. I don't know, I'm not a legal professional, but it smacks of illegality.

Why the gag orders? Is that usual? It meant none of the targets ever knew what was happening.

(7,947 posts)If not... why did the DOJ insist?
And of course, who ordered all this? It wouldn't happen just on the say-so of a low-level attorney.

Then came this disconcerting passage: The government disclosed approximately 25 pages of documents in April and May 2020 as the result of an independent review of this case by the United States Attorney for the Eastern District of Missouri. While those documents, along with other recently available information, see, e.g., Doc. 198-6, are relevant to the governments discretionary decision to dismiss this case, the governments motion is not based on defendant Flynns broad allegations of prosecutorial misconduct. Flynns allegations are unfounded and provide no basis for impugning the prosecutors from the D.C. United States Attorneys Office.
This passage proves disconcerting for several reasons. First, the paragraphs construction creates the false impression that there was no prosecutorial misconduct involved, while, in reality, it does not say that at all. Rather, Assistant U.S. Attorney Jocelyn Ballantine, who signed the brief, merely asserted in the governments brief that its motion is not based on defendant Flynns broad allegations of prosecutorial misconduct.
But what about narrow and specific allegations of prosecutorial misconduct and specifically Powells claim that federal prosecutor Brandon Van Grackwho has since withdrawn from the caseimproperly withheld material exculpatory evidence from Powell?

(39,074 posts)rages about the FISA court investigations of Flynn. While at the same time he is spying on Democrats. He calls Shiff "Shifty Shiff" . He talks about Obama golfing then golf 4 times as much himself. Trump is responsible for thousands of unnecessary COVID deaths then he goes on a campaign against Dr. Falchi calling him a murderer.
You can bet if Trump accuses someone of something he is guilty of it himself.
