This has been what I term an under the radar issue. It doesn't get as many posts or replies as it merits. The thought of a staggering 7-2 Supreme Court advantage to me is certainly worse than 6-3.
No doubt Moscow Mitch will do anything his evil mind can contemplate to stop Democrats at every turn, especially judicial appointments at all levels.
I know Breyer is an intelligent man, but it seems like he has no concept of history. I thought a few months back that he would be aware of the history and what happened with Marshall, Brennan and Ginsberg.
It seems like word surfaced that Breyer thought he could help in matters like abortion and redistricting to mitigate the effects of the majority. However, that alleged influence was not evident at all in the recent decisions regarding the two important sections of the Voting Rights Act, that has been decimated over the years by ultra conservatives on the Court. Breyer couldn't persuade or influence them then and he won't be able to do so starting next fall as well.
He also needs to consider that the Democrats' fragile and slim majority, 51-50, with Harris breaking the tie could be endangered if Senator Leahy of Vermont who has experienced health challenges had to leave and that state's GOP Governor appointed his successor. Also, if Feinstein of California experienced health woes and could not serve that spot would be temporarily vacant until a Democratic governor tabs a successor.
I am sure some have tried to convey messages similar to this to Breyer, but for whatever reason he just doesn't want to step aside for the good of the team.
