"SNIP.....
Supreme Court Justice Stephen Breyer has hired full complement of four law clerks for fall term, Bloomberg reports.
This suggests Breyer is not planning to step down as had been anticipated by some.
David Lat: Remember Justice Breyers recent Harvard Law School speech
in which he argued that the Court is not as political and politicized an institution as many people think? It now looks like a preemptive defense of his decision to stay on the Court.

(12,549 posts)I do too, big time. Does he have to actually retire or can he say he will retire when a new replacement is ready? Announcing retirement should be enough to start the process. Lifetime appointments don't mean it has to be until death either. I trust Bryers decision but we all move aside and it all goes on.

(10,896 posts)Even if he did choose to retire, he has no guarantee of when or how soon his replacement would be appointed and seated.
It's best to be prepared for the next term, no matter the choice.
